Humboldt GOP may get nothing if suppression motion for vandalism suspect is granted

 

In April 2022, GOP vandalism suspect Michael Valls resolved his case  with a one year diversion, a stay away from the Humboldt Republican headquarters with an exception if he is on Hwy 101. Judge Christopher  Wilson ordered EPD to return Valls bike.

There was a victim restitution review hearing on 5/26 which was rescheduled for 6/22. That date was vacated. Defense continued the hearing to 8/11 for a restitution hearing. Conflict Counsel subpoenaed Eureka PD for records. Deputy Conflict Counsel Owen Tipps took over the case from former Deputy Conflict Counsel April Van Dyke recently and after the plea. Ms. Van Dyke left to  take a position in another county.

On 8/11,  defense requested another continuance which was granted and the latest date is 8/25. E court listed a PC 1538.5 suppression motion for 8/11 which is not addressed in the court minutes so I assume that is also continued for the next court date.

Final diversion hearing is scheduled for 4/26/23.

4/26: Final diversion hearing for today was vacated.

Review hearing diversion and status of payments on 8/14/23. 

Final diversion hearing on 8/28/23.

8/14: DA states restitution payments have been received.Judge Steven Steward says that $100 diversion fee payment should be provided on 8/28

 9/12: $100 diversion fee  stillneeds to be paid.

 10/16 : Final payment made. Case dismissed
