Residents in Mckinleyville and Orick received postcards from Larry Doss, candidate for 5th District Supervisor wishing them Happy Halloween.

Team Up Humboldt is the website That and Doss' logo  are on the postcard. 



Madrone has personally told Doss that he will be running for re-election.

HCSO arrests man on confidential federal warrant







Tyler William Abbott was arrested by HCSO and booked on a confidential federal warrant this morning. The warrant is from UST Region 18.

In my initial post about the "EPD texts" months ago, I predicted this development and that Chief Watson would be one of the targets. I made some remarks and observations in my last post on the news about Chief Watson leaving. 

Allen Don McCloskey arrested on stolen property and firearm charges



Allen Don McCloskey was arrested yesterday by HCSO on N. Westhaven. His bail was $25,000 which he posted. McCloskey was arrested for  PC 496(A) receiving stolen property, PC 30305 (a) possession of ammunition by a prohibited person, PC29800(A) felon in possession of a firearm and PC496D(A).

Dare jury got it right, Watson jury did not, Anaya is not a case I followed

Since I was covering the Mark Dare sentencing and the Michael Acosta case, I did not post on the Brandon Watson sentencing. 

I wouldn't have covered it anyway. If you read my coverage of the trial, you know why. I linked the last three posts on that case.

The Anaya case is not one I was following.

On Oct. 29, 2021, at about 1:05 a.m., Humboldt County Sheriff’s deputies on patrol in the area of Highway 101 near School Road observed a motorcycle that had been reported stolen out of Arcata.

Defiant, unremorseful Mark Dare gets 46 years to life in prison to be served concurrently

 


Convicted molestor Mark Dare was  sentenced this morning to consecutive terms and the total prison sentence is 46 years to life. He has to register as a sex offender for life and will be on parole for life. Dare has 472 days of credits.

Trial setting and appointment of counsel was scheduled this morning for Michael Acosta and Sarah Carroll.

17 total cases, failure to appear in two gets Michael Bowman a no bail warrant


Michael Wayne Bowman with 17 criminal cases in the system was arrested yesterday on a bench warrant because he failed to appear in court for two of his open cases.

Visiting Judge Marjorie Carter issued a no bail warrant in the assault case which was on for arraignment. In the vandalism case, the warrant was for $5,000.

What message is the Humboldt GOP sending to people driving and walking by?

 



Granted they have had vandalism incidents in the past but this is what the Humboldt GOP office at 311 5th street in Eureka looks like. Who knows if this is just on the days they are closed, whether they are temporarily closed or permanently closed. Maybe post your hours?

On October 28th, 2021, special agents with the Humboldt County Drug Task Force (HCDTF) attempted to serve a search warrant and arrest warrants at an apartment in the 2500 block of Alliance Rd. in Arcata. 

Restaurant still open despite someone breaking the windows last night





Heard several people downtown say this morning, "they just opened and now they are boarded up." I went to Las Michoacana's on 5th street in Eureka. This is the old Rita's location, right next to the Royal Inn.

There was a sign saying we are open but also the windows boarded up. Spoke with staff. She said someone broke all the windows on 5th street.

They are open, including for dine in, except for the tables near the windows boarded up.

Supervised release for a violent man who resisted arrest and is charged with battery on a police officer

 


Gerald Fay Barnhart, who resisted arrest and is charged with battery on a custodial is out on supervised release. His arrest was a result of a domestic disturbance call.

The message California legislators and any California Judges are sending is domestic violence charges don't matter. nor do the lives of law enforcement. You think a protective order is going to stop this man?

Naked selfies, period sex, deleted accounts, will Patrick Marshall only be sentenced to probation and DEJ?


Alleged molestor Patrick Marshall entered a plea on October 21 for one added count of lewd acts with a minor as a misdemeanor. 

The defense made an offer which the People accepted. So besides registering as a sex offender, probation and a DEJ will there be any other consequences for Marshall?

Anyone else with his record wouldnt get DEJ and dismissals

 


On October 18,  Rob Christensen was sentenced for two cases with a deferred entry of judgement. 

I already addressed the special justice for people like him, his record, dismissals and how it got to this plea in the last post. Christensen is a former staffer for California Senator Mike McGuire.

Change of plea scheduled for Victoria Copeland


Victoria Copeland DUI case is scheduled for a change of plea on November 5. Mr. William Stein is her attorney. 

What the men and women of EPD need is the City of Eureka to have their back and tell them who is taking over as interim police chief

EPD Chief Steve Watson retiring is not unexpected or breaking news. The City has still not provided an update to the EPD text investigation. Not that it matters.

Far it be from the City of Eureka to take responsibility and address the issues that EPD faces every day.  There will be no change, just colorful brochures and paperwork with lengthy policy no one reads. The change people want politicians and government do not deliver. 

Easier to find a scapegoat or have someone retire or fire a few people while the inept at the top maintain their cushy jobs and the status quo.

EPD Captain Brian Stephens has been the face of EPD more than Chief Watson since this "investigation." And I can bet you the chances that he will take over, at least as interim chief, is very likely. I can tell you that some people and officers may like that choice. Others will not. There is already concern in the community and the department.

What the men and women of EPD need is the City of Eureka to have their back, tell them who is taking over as interim police chief and address the reality of working in Eureka as a police officer.

Senate Finance Committee Chairman Ron Wyden is proposing a levy which "would apply to taxpayers who for three consecutive years have had assets worth at least $1 billion or have earned at least $100 million three years in a row. "

According to Bloomberg, the thresholds mean about 700 people would be affected, according to a summary of the plan."

Kidnap and mayhem suspect Cory Nelson's sentencing took place this morning. He resolved four of his cases with a stipulated plea deal for a 14 year prison sentence.

Emergency leads to closure of courthouse in San Jose

Due to an emergency water shut-off affecting the entire city block, the Robert F. Peckham Federal Building and Courthouse in San Jose will be closed to all visitors on October 27, 2021.  More information will be provided as the situation develops.

On 10/26/2021 @ 2327hrs Humboldt Bay Fire responded to a Boat Fire/Explosion w/ multiple injuries @ #1 Marina Way at the Eureka Public Marina.

Another familiar face for law enforcement


In 2018, a jury found repeat offender Donavan Baltzley guilty of two counts of being a felon in possession of a firearm and two counts of being a felon in possession of ammunition, all felonies.

After the verdict, Baltzley admitted the special allegation that he had previously served a term in prison.

Baltzley was arrested today on firearm, drug, counterfeit money charges and for probation violation.

Convicted sex offender gets O.R. and so does guy with alleged violation of parole

 



Now that booking logs have been restored.

Joseph Arthur Titus was booked on October 16 for failure to register as a sex offender and released on O.R.

Ryan Christopher Moore booked for driving/taking a vehicle without consent theft, providing false id, parole violation.  Even with a parole hold, a judge can choose to release from custody in Humboldt. Moore is no longer in custody because he was also released on O.R.

You can thank California legislators for blanket laws on "bail reform."

Setting of sentencing for Demetrius Coleman scheduled for November 17


Argument for new trial/sentencing for convicted murderer Demetrius Coleman was scheduled for October 26. It was continued to 11/17 for setting of sentencing. On the same day is a petition hearing to disclose confidential informant/juror information.

Delaware corporation doing business in California cited for $1,164,500 for violations


The Labor Commissioner’s Office has again cited Bodega Latina dba El Super grocery stores in Southern California $1,164,500 for failing to provide or delaying supplemental paid sick leave or other benefits to 240 workers at 38 locations affected by COVID-19.

Update after court hearing : Family members said they cried in court as the plea was entered. Ms. Andrea Sullivan confirmed that Johnson pleaded guilty to three counts of murder and admitted three special allegations for use of a firearm causing death for the killings of Nikki Metcalf, Margarett Moon, and confidential minor victim Jane Doe.

The People accepted defense offer of 150 years to life in prison. Johnson will have a parole hearing in 25 years. A hearing to confirm sentencing is scheduled for 1/14/22. Sentencing is on 1/21/22 and scheduled for all day.

Another restaurant for lease in Eureka




La Chaparrita located near McDonalds on 4th Street in Eureka is closed with a sign, "For lease." 

Checked Google. Yellow pages and Yelp had current information.

Sizzler on 5th street, which I reported months ago had a sale pending sign, the property has been in escrow for a while.  I had reported Subway franchises in Humboldt were for sale. Another listing states the Crescent City Subway franchise locations can be part of the deal.
