Cher-Ae Heights Indian Community of Trinidad Rancheria  and Pacific Affilates, Inc. sue each other

 


A case management conference was scheduled on December 6 in a lawsuit filed by Cher-Ae Heights Indian Community of Trinidad Rancheria  vs. Pacific Affilates, Inc. There is a cross complaint filed with Roes 1-100 as parties. These are some of the court records and court minutes. Pacific Affiliates is owned and operated by Travis Schneider.

Jeremiah Hathaway Johnson was arrested by HCSO  yesterday for CP 1209, contempt of court and public intoxication and released on OR.

Eureka Police Department released more information about the December 30 incident which resulted in a response by all first responder agencies.

"We need the Court’s help in shaping this case for trial. Since the day we took over Mr. Christie’s defense, we have faced the same overarching problem, which has only become worse with the passage of time."


Ray Christie's lawyer, Mr. Rick Richmond, had said at the December 27 hearing he would be filing a motion to continue. 

Today, the defense filed  two declarations by Mr. Richmond, a motion to continue trial and related orders.

Ten EPD cars headed out of town on 5th Street





At 2:47, Jesse Smith texted me that 10 cars raced down 5th Street going out of town, followed shortly by two black SUVS. 

I was near 3rd and T. EPD and HCSO on scene. Crime tape. One guy sitting on the sidewalk behind Red Lion Hotel.

Found out  EPD is the  lead agency. Law enforcement looking for suspect near greenbelt. EPD and HCSO on 5th and 6th street. 

Nazy Javid from North Coast News just walked up. She is on Facebook live. We are headed to 5th street.

Felon arrested for violating restraining order, posession of meth, weed and firearm


On Dec. 30, 2021, at about 1:06 a.m., Humboldt County Sheriff’s deputies on patrol in the McKinleyville area conducted a routine traffic stop for a vehicle code violation on Central Avenue.

DA continues hit and run preliminary because witness is ill


On December 8, the District Attorney made a motion to continue hit and run suspect Demmeri Carr's preliminary hearing because the witness was ill. The date was rescheduled for 3/8/22.

Inmate misses two hearings due to COVID 19, local attorney also in quarantine

 


Alleged rapist Timothy Miller-Roberts was unable to attend last two court hearings due to COVID 19 quarantine and protocols at the jail. His January 3 jury trial date has been vacated. A change of plea is scheduled for 1/12/22.

It isn't just inmates at the jail in quarantine because either they or some other inmate tested positive but a local, private defense attorney is in quarantine and  a source outside the courthouse said that attorney is "very sick."

Thanks to the public, this hit and run suspect is in custody

 


Arcata Police asked for the public's help on Facebook six hours ago. The hit and run suspect is already in custody for PC 496(d) possession of stolen property and VC 20002(a)(1) hit and run. 

Caltrans has closed 45 state highways since December 24 due to record snowfall in the Sierra Nevada

Since my post on December 27 on the defense motion to suppress evidence from the October 2021 federal raid at Ray Christie's property, I have heard from a lot of people, including lawyers from all over California. 

The consensus is that Humboldt Superior Court Judge Elvine-Kreis made a ridiculous ruling; an incorrect ruling; the defense could file a writ and definitely appeal the ruling depending on the outcome of the trial. 

Many people expressed an interest in reading detailed testimony from Monday's hearing.

All three defendants found not guilty on all counts, another loss for DA and another loss for Mackie


The jury in the Carson, Rashad LaFrance and Ludford cases started deliberating yesterday. Asked for a transcript of the entire trial yesterday.  In 24 hours, not guilty on all counts. All three defendants released.

Ms. Andrea Sullivan represented LaFrance, Ms. Christina Allbright and Deputy Public Defender Ben McLaughlin represented the other two defendants.

Two EPD cars with sirens turned from 3rd and V onto 2nd


Sirens blaring, lights flashing two EPD cars just turned on to 2nd Street from V.

I contacted EPD Crime Analyst Brittany Powell. "I believe this was for EPD responding to the report of a male causing a disturbance at the 2500 block of 4th Street.  Male was throwing things and being physically aggressive towards customers.  The male was identified as Jean Davignon and was arrested on a warrant and fresh charges."

Sheriff Honsal declares local emergency due to winter storm conditions and related damages


Sheriff William Honsal has declared a local emergency related to the ongoing life-threatening winter storm conditions and resulting damages experienced throughout Humboldt County. 

Right after one jury starts deliberation, another trial already ready to start in same courtroom

The jury for defendants Carson, Rashad LaFrance and Ludford case will start deliberations tomorrow. The three defendant trial concluded closing arguments this afternoon in Courtroom 3. Ms. Andrea Sullivan is representing LaFrance. Ms. Christina Allbright one of the other defendants.

Deputy District Jane Mackie is the prosecutor on the case.

Two Eureka criminals on probation arrested for armed robbery in Mendocino

On the morning of December 25, 2021, the Eureka Police Department (EPD) received information that Eureka residents, 33-year-old Brandon Haselip and 31-year-old Michelle McDaniel had active arrest warrants for committing armed robbery in Mendocino County.  

Jason Miller picks up another case

 


There was a trial confirmation hearing scheduled today for Jason Miller aka "Crow" which was continued to tomorrow. Miller has another case and today Ms. Andrea Sullivan was also court appointed to represent him on the second case.

Miller allegedly assaulted Mark Dare, the convicted molestor at the Humboldt County jail. Dare is in prison so why file the complaint now?

Kimi Taylor arrested for elder abuse and battery

Kimi Taylor was arrested by Eureka Police Department yesterday for PC 368 (b)(1) elder/dependent adult abuse and PC 243 (d) battery that causes serious bodily injury. She posted bail which was $ 35,000.

The Clarion hotel has been up for sale for quite a while. The new owners were in town yesterday.

On Dec. 23, 2021, at about 9:14 p.m., Humboldt County Sheriff’s deputies were dispatched to a residence on Teh-Pah Lane, on the Trinidad Rancheria, for a death investigation.

Are HCSO and State witnesses going to call a federal agent a liar or contradict her because she clearly states multiple times there was no communication or authorization to gather evidence for the state trial?

 


With all the recent developments in Ray Christie's retrial in his Humboldt Superior Court criminal case, who knows what will happen on December 27?

The federal agent in charge of the October 2021 raid, Anitra Mackie, has provided a declaration to the defense for the December 27 hearing.

2726 P Street wins City of Eureka holiday decorating contest



DA's office did not inform or serve defense of crucial filings in criminal case

 



The Humboldt County District Attorney's office filed an opposition to the defense motion to suppress on 12/16. The DA's office also filed a request for an in camera hearing on 12/20/21.  There is no proof of service filed for either document. 

I spoke to Mr. Richmond on 12/22 and asked him if he had received any paperwork including any opposition/responses. He had no idea of either filing by the DA's office and found this out through me just now. 

The post it notes are a year and nine months late

 


Saw these post it notes all over the Courthouse building where there are Smokestack Cafe menus in the building. Not what's up with the post its now but whoever put it up is a year and nine months late. The cafe has been closed since last March due to the pandemic and rent had been waived by the County. Just like the vending machines which weren't available until this September; a year and a half late and don't fix the issues created by the unavailability of the cafe.

HCSO and DA, "you've got some 'splaining to do"

 


This is installment #2 of a post I did earlier about the Ray Christie case. The defense has filed a motion to dismiss criminal charges against Christie or as an alternative are asking for suppression of evidence from a March 2018 raid as a sanction because the People failed to preserve exculpatory evidence.

There is already a hearing scheduled for December 27 on a motion to supress related to the October 2021 federal raid. Deputy District Attorney Steven Steward intends  to use evidence from that raid in the retrial for Ray Christie currently scheduled for January 2022.

EPD just issued a press release. Crime analyst Brittany Powell said today's booking photo was not available, yet. The booking photo provided from EPD is from 2020.

The Redwood Coast Energy Authority (RCEA) is extending the benefits it provides to local businesses to include Food for People.

The California Court of Appeal, Second Appellate District, ruled that South San Francisco based California See's Candies' must face a lawsuit by an employee who says she caught COVID-19 at work, then gave it to her husband which resulted in his death.

Prepare yourself for more chaos with next year's judicial assignments

Starting first of the year, there will be some changes in the Humboldt County courts. The not so brilliant minds that changed how courts run have come up with more wacky ideas which will create more chaos and backlog in the local courts.

Presiding Judge is Judge Gregory Elvine-Kreis and Assistant Presiding Judge is Judge Kelly Neel. I already reported on this on December 15. There are more changes including courtrooms and assignments.

County closed Thursday and Friday; Courts only on Friday


If you were thinking of stopping by at any County office this week; nothing will be open Thursday or Friday. Humboldt County chose to give an extra day off for Christmas Eve.

Courts are closed on Friday. I bet only one entrance is open on Thursday since the only people in the building would be for court related business. The County issued a press release on December 22.
