Kyle Berryman arrested for failure to disperse at scene of riot, trespassing, criminal threats, false imprisonment by Cal Poly Humboldt police

 


The name sounded familiar. Then I saw the charges on the Humboldt jail log. This arrest cannot be found on the Cal Poly Humboldt crime log.

Kyle Steven Berryman was arrested by Cal Poly Humboldt police yesterday at 11:30 p.m. and booked for PC 422 criminal threats, PC 236 false imprisonment, PC148 (a) (1) resisting arrest, VC 2800.2 reckless evading of a police officer, VC 22450(a) running a stop sign, PC 409 failure to disperse at scene of riot and PC 602 trespassing. Berryman was arrested by former HCSO deputy Joe Conlin who now works for Cal Poly Humboldt police. Bail is $25,000.

Booking photo has been requested. If you rely on Vinelink for notification, Humboldt County Sheriff system, which is rarely down, is offline. I have informed HCSO and Captain Duane Christian. When this happened in the past, it is always after a weekend and I would inform former HCSO PIO Samantha Karges. The County cutting corners, outsourcing tech and this is the result.

I  hope this is a technical issue and not a convenient offline status hours after KRFH was told that 200  police were being mobilized and supposed to converge on Cal Poly Humboldt campus today.

So the Cal Poly Humboldt update today was a distraction

 

This was posted two hours ago.

There is some information that the police may come at 10 p.m. With the way Cal Poly administration is behaving, who knows if it will be tonight or tomorrow.




Cal Poly Humboldt administration is being exposed. The usual anon Humboldt entrenched insiders on LOCO and RHBB who hide behind a screen to conceal their real identities and conflicts of interests are pissed. These keyboard warriors dont care about Israel or Gaza. They are just angry that  the students are speaking up and raising awareness. The selfish predators in Humboldt who leech off Cal Poly Humboldt are only concerned about their interests. 

I hope the rest of the country and the world is watching how those in charge in Humboldt, the selfish failures who should never be in power, react when exposed. Bullies, using money, the police and the criminal justice system for their ineptness. Kreis and Cal Poly Humboldt admin are of the same ilk. Deny, blame and accept no responsibility.

I did find this about graduation on the Cal Poly Humboldt website.

"Many people have asked about Commencement. The University is planning for various scenarios to help students and families celebrate this important milestone."

No one asked Cal Poly administration to overreact and send in police in riot gear the first day. No one asked Cal Poly administration to close the entire campus. People's graduation is not affected because they don't get a photo op on campus to post on social media. Inconvenience is not being able to go to the courthouse in person or government offices for life and liberty decisions  due to COVID closures; it isn't remote learning caused by an inept, tone deaf administration. If you can post online and whine about other students trying to make a difference; you can spend that time and internet access for your education.

If you know the history of this country, care about the constitution and are a true patriot, you would be apalled that you now live in a United States where the police and criminal justice system is weaponized to silence an opinion inconvenient to the wealthy and those in power. The same people screaming for the arrest of these students can only speak today in a country because of events such as the Boston Tea Party. Should those protestors have been arrested too?

People had to vote out Gregory Kreis. 
Students are standing up and speaking out against violence while the Humboldt fat cats hide behind a screen continue to bully, oppress and refuse to take responsibility for the lack of housing, lack of economic opportunities and despair they created. Fat cats living on a government paycheck and generational wealth entitlement. Police and the courts are supposed to protect people; not harass them. Humboldt is a joke in holding abuse of power accountable. Crickets from the rest of the local "media" as usual. Did they get their marching orders from their overlords? Those media are always MIA when it counts.

CalPoly Humboldt sent an "update" out at 10:06 a.m, hours after yesterday. It regurgitates some of the same doublespeak, information already known which Cal Poly Humboldt could have released earlier. All this confirms what was already posted online hours and days ago and should have been included in the original press release about the closure. 

ACLU of Northern California issued a statement which is on their website. 


"During times like these, several fundamental protections come to the forefront. First, there’s the right to freedom of expression and assembly enshrined in the United States and California Constitutions. Second, there’s the right to be free from unreasonable and excessive force at the hands of law enforcement. And third, there’s the core principle that these rights apply universally, irrespective of one’s viewpoint, race, ethnicity, or religion. These protections, however, only survive if we have other fundamental guarantees in place — a free press on the ground, access to legal counsel, and due process."

We will find out what ACLU will do, if anything later today to ensure these protections for the Cal Poly Humboldt students or this paragraph is just empty words.

Deputy Public Defender talks to witness, judge finds violation of motions in limine and jury trial of convicted felon with 5 open cases maybe in jeopardy

 


Convicted felon Jesus Loza Zamacona has five cases on calendar on 4/29/24. There was a jury trial going on in his felon in possession of a firearm, felon in possession of ammunition and three strikes case. On 4/25, Deputy District Attorney Ian Harris informed Judge Lawrence Killoran about a conversation between Deputy Public Defender David Nims and a witness. There was an evidence hearing. Judge Killoran found there was a violation of  motions in limine. Mr. Harris requested that the Public Defenders office be relieved and new counsel be appointed. Judge Killoran had further discussions which included Public Defender Luke Brownfield and Deputy Public Defender Casey Russo. This was all outside the presence of the jury. Jurors were told to return Monday. His other 4 cases are trailing and include charges of domestic violence, violation of a court order, lewd act with a minor and child abuse or endangerment.

Very troubling allegations made by Raymond Bacon and his partner against each other, who is protecting the children?

 


I reported on April 8 that 47 year old Raymond Bacon was arrested by Eureka Police Department. He is Yurok Tribe's Economic Development Corporation's executive director. According to his Linkedin profile, he previously worked at Cher Ae Heights Casino. His Facebook profile says he is the former Chairman of the Yurok Tribal Gaming Commission. Bacon was booked for PC273(a)(b) willful child endangerment, PC 236 false imprisonment and PC 273.5 (a) corporal injury to a spouse  or cohabitant.

I looked up court records from Humboldt Superior Court on Bacon. The restraining order confirms a tip I received that Bacon was arrested after the restraining order was granted. As I reported in previous coverage, Yurok Tribe Councilmember Sherri Provolt is Bacon's boss. I have also reported on her son John Provolt's indecent exposure case for an alleged incident at Good Relations in Eureka.

Cal Poly Humboldt just released a statement. 

The students have not responded and the response to this statement is a mix of differing views we have already heard. The administration refuses to acknowledge that they escalated by calling in the police. The water jug and video has gone viral. Sending in police with gear like that was dumb. There was no need for the over the top police presence that first day. From both sides, there has been nothing new in these constant updates and still no idea about Humboldt graduation. As long as law enforcement remains on campus, the Cal Poly administration is responsible for this stalemate. 


Someone claims to have video. Post it. Otherwise it is just unverified chatter.


Why has this "press" person not reported or provided proof. If it is local "media" who was on scene, I don't expect an answer or actual guts and journalism.


Cal Poly administration doubling down by sending out these ridiculous updates instead of saying we overreacted, opening the campus and keeping law enforcement around and on call. These are the "geniuses"who thought students should live on a barge  because they did not plan ahead. How much money is Blue Lake Rancheria making on rooms rented to law enforcement who are not needed? Why are these administrators being paid for days of allowing Humboldt to be a national embarassment in the headlines?

Unless you have authorization from CalPoly Humboldt police, you cannot be on campus


CalPoly Humboldt issued a press release about a hard closure of the campus. Anyone on campus without permission or authorization from CalPoly Humboldt police is subject to citation or arrest. This development is already getting regional and national coverage.

Michael Black remains shackled in court, can now post bail if he has the money and served with a protective order

 


At his preliminary hearing for his 2024 case on 4/25, Michael Black remained shackled during the proceedings. A protective order was served on him. Judge Steven Steward held him to answer on all charges. No bail status was changed to bail $250,000 after arguments from Ms. Sullivan and Deputy District Attorney Jessica Watson. Ms. Sullivan won the bail argument even though she was not served the declaration by the People and had to review a copy last minute. Arraignment on information is on 5/8.

Jury trial confirmed for woman charged with the murder of her roomate

 


On 4/25, homicide suspect Destinee Rhamy's case was on for trial confirmation and motion to compel discovery.  The discovery motion was dropped from the calendar. The case file was not in court but jury trial was confirmed. Trial assignment is on 5/3; jury trial and motions in limine are scheduled for 5/6.

Rhamy is charged with the murder of her roomate Holland Elbik.

Women who sued County for delays in mental health services arrested by EPD for attempted murder?

 


33 year old Kristen Audrey Wise was arrested yesterday by Eureka Police for PC664/187(a) attempted murder.

A Kristen Wise of Eureka sued the County of Humboldt and California Department of Health Care Services for delays in providing mental health services. I was the first one to report on that lawsuit. 

This is the weekend, it is a very busy day Monday and a full day in court and the week is just as busy for the people who can confirm this is the same woman. I will update the post when I have additional information. 

19 year old arrested by CalPoly Humboldt police for criminal threats, stalking, sexual battery and false imprisonment

 


19 year old Viktor Ortega arrested by CalPoly Humboldt police yesterday for PC 422 criminal threats, PC  236 false imprisonment, PC 243.4 (a) sexual battery and PC 646.9 (a) stalking.

Ortega was arrested a day earlier on 4/25 for PC 647 (f) public intoxication and released from the jail per PC 849 (b) 2).

It has been verified. At 2:10 CalPoly Humboldt sent out a press release. 4: 44 update: "The offer for protestors in the buildings to leave with a guarantee of no immediate arrest has been extended to 5 p.m. Those who walk out peacefully by the deadline will not be immediately arrested and will be able to leave campus without being arrested. This does not, however, eliminate University conduct-related sanctions or legal implications. In addition, voluntarily departing in this way will be considered as a mitigating factor in University conduct processes and may reduce the severity of sanctions imposed."

Bench warrant issued for John Provolt in his indecent exposure case

John Provolt failed to appear in court yesterday for trial setting in his indecent exposure case.Trial setting was continued and a bench warrant for $10,000 was issued and held until that date. Ms. Andrea Sullivan is Provolt's attorney. Deputy District Attorney Candace Myers appeared on the case for the People. More details about the case in my April 11 post.

Elder and one of the alleged victims in Socorro Cervantes' criminal case is also requesting a restraining order

 


Former Humboldt Superior Court assistant operations manager Socorro Cervantes was arraigned today in the criminal case for her 2024 arrest. In the criminal case, Cervantes is charged with 6 counts which include two counts of burglary, one count of robbery, one count of petty theft, one count of evading a peace officer and one count of theft from elder or dependent adult. Alleged victim for four counts is William Edgar Puryear, alleged victim for petty theft count is Jeremy Michael Tout and the officer is not named in the complaint. Dates were also scheduled in her 2023 case. She had a bench warrant in that case and had failed to appear in court.

She has another 2024 lawsuit, a request for a temporary restraining order by Puryear was granted by Commissioner Sarah Kaber. There is a hearing scheduled on 5/17. Cervantes is a former tenant. Mr. Dustin Owens is Puryear's attorney in the civil lawsuit.

Suspect in Cutten OIS shooting walked up to 75 year old woman, shot her multiple times in front of her sister and then fled the scene


On April 25, 2024, at approximately 10:31 a.m., the Sheriff’s Office Emergency Communications Center received a 911 call reporting a person had been shot in the 2400 block of Fern Street, Eureka. Deputies were immediately dispatched to the area. While deputies were enroute, it was learned that a White Male Adult walked up to a 75-year-old woman who was standing in front of her garage with her sister and shot at her multiple times. The woman was struck by gunfire, and the suspect fled on foot westbound on Fern toward Walnut Avenue.

Michael Acosta is ineligible to practice law in California







On April 15, I reported that Gerald McGuire did not want Michael Acosta as his attorney anymore in his lawsuit against County of Humboldt. On 4/19, Acosta was removed as counsel. McGuire is representing himself against Deputy County Counsel Thomas Chapin. 4/19 court minutes state that Retired Judge Christopher Wilson noted Acosta is unable to practice law. I had previously reported in one of my posts in Acosta's case that his conviction record had been sent to the California State Bar.

21 year old arrested by Rio Dell PD for assault with a deadly weapon and DUI

 


For a small police department, Rio Dell Police Department does a great job. They made an excellent choice to hire Chief Greg Allen. I hope he runs for Sheriff. As a former HCSO Sgt and someone I have seen in the field, in the courts, Chief Allen's  experience, temperament and professionalism is what Humboldt needs.

Why was Brandon Widmark's fugitive from justice case not filed with the other 2023 cases?

 


I am not doing multiple posts just because a defendant has cases scheduled three times in a week. This isn't just for Brandon Widmark. It happens with other cases too. Widmark has picked up a new case which should have been filed in 2023. Yesterday, one of Brandon Widmark's 2023 cases was on calendar as well as a new fugitive from justice case filed against him in 2024. The latest case is for an outstanding warrant from Oregon. Brandon Widmark has a third case with hearings on different days and multiple continuances. All updates unless something major will be added to this post.

DA to retry Nick Martinez on two counts, 90 day jail sentence and sex offender registration for the one count he was found guilty by the jury

 


Deputy District Attorney Whitney Timm had not filed anything about retrying Nick Martinez; at least it is not in e court as of this morning. The case was scheduled yesterday for sentencing and  trial setting. Judge Steven Steward denied Ms. Timm's request to continue sentencing. The DA is retrying Martinez on Count 1 and 4. There was a hung jury on those two counts. Martinez was found not guilty on Count 2 . The jury convicted Martinez on Count 3 and he was remanded into custody yesterday to serve 90 days with credit for 21 days; he was placed on probation for one year and has to register as a sex offender. Martinez is on no bail on Ct 3; bail bond remains in effect to Count 1 & 4. Ms. Andrea Sullivan is Martinez's attorney.

HCSO unable to serve Aunna Bollman with DANCO request for workplace restraining order despite multiple attempts

 


The hearing on Danco's request for a workplace harassment order against Aunna Bollman was already continued on 3/29. I am sure it will be continued again today. HCSO has been unable to serve Bollman. The hearing was continued again to 6/21. With 9 open cases and two additional cases in which restraining orders were granted, Bollman should never have been allowed to remain out of custody.

Courtroom packed with supporters for Lt. Sam Williams

 


Sentencing for former HCSO Lt. Sam Williams and is going on currently. There are more supporters here for Lt. Williams; about 14 people including his daughter, fellow church members including Pastor Andy and his wife Cindy and Brian, an investigator from the Public Defender's office who previously worked for Probation. That side of the courtroom was full. More people would have been to support Williams. Some law enforcement had other work obligations including waiting to be called for preliminary hearings. 

 I reported previously that Deputy Public Defender David Celli has filed a motion to reduce the felony to a misdemeanor. That motion was denied by Judge Timothy Canning.

Williams' wife and her lover were in court. Sitting with them was  Victim Witness Advocate who has to be there. A probation representative was sitting on that side. Other than those four people, that side was empty. Deputy District Attorney Emily Norgaard who was the prosecutor for the preliminary hearing briefly stopped in today.

Williams has lost his job and his pension.

Instead of the recommendation of 120 days in jail and felony, Judge Canning sentenced Williams to 90 days in jail and two years felony probation. Williams is eligible for SWAP. Commit to jail date is 5/18.

Case dismissed! Rawson would never have been arrested or charged had there been proper investigation and vetting

 


After his preliminary hearing yesterday, the 2023 case against Jack Rawson was dismissed. Judge Steven Steward did not find sufficient evidence to hold Rawson for the charge  of felon in possession of a firearm. 

Since he was arrested, I knew some information and had there been proper investigation before Rawson was arrested or even before charging him; all this could have been avoided. I am aware of Rawson's past. After years of not hearing about him; there is this arrest in 2023. Rawson must feel vindicated. Will he make a video?

Former Humboldt Superior Court assistant operations manager Socorro Cervantes drunk in public, aggravated trespass arrest and embezzlement conviction. Today, HCSO was arrested again on burglary and other charges.



I have covered Socorro Cervantes since 2015 and covered her embezzlement case in detail. I will be adding court documents for her 2023 case. She failed to appear for arraignment in CR2301852 and a bench warrant was issued on 7/26/23.

HCSO MET serves warrant and investigates illegal cannabis cultivation in Berry Summit area




On April 17, 2024, deputies with the Humboldt County Sheriff’s Office Marijuana Enforcement Team (MET) served a search warrant to investigate illegal Indoor cannabis cultivation in the Berry Summit area of the County.

Barnum Timber Company and CS Timber LLC notified of Fish & Game violations in conjunction with cannabis cultivation. I contacted Bill Barnum because the letter to Barnum Timber Company was sent to Elk Grove, Illinois which is the mailing address for CS Timber LLC. Mr. Barnum was not even aware of this until I contacted him so is looking into it and I will update the post with his response.

I then received this from Sgt. Moore at 10:19 a.m.

Regardless of it being "sent in error", it was sent out to local, regional and national media including the Associated Press. Other than there being no date, the Barnum Timber Company is local and has a local registered address in Eureka. If there are no violations, Fish and Game can send me something stating that clearly. Barnum Timber Co and CS Timber LLC  can take up the "error" with Sgt. Conan Moore and HCSO.

If media was just not supposed to get it but there is an investigation, the information has been received and this is information relevant and of interest to the community. If Fish & Game is going to make allegations about a well known, local, generational family and is making errors, then the rest of their information should be vetted. 

4/24: Mr. Barnum has sent me a response. "Barnum Timber Company, LP sold that 80 acre parcel several years ago. Not sure why HCSO could not figure that out." Open Corporates information is not always up to date. Mr. Barnum clarified the status of Barnum Timber Company, Inc. "That entity existed from 1974 to 1986. Our present company is a limited partnership formed in 1985."
