PG & E just issued a press release stating Humboldt homeowners and contractors could be billed if they didn't call 811 and caused damage during any dighing projects.

James Sandness was arrested by HCSO yesterday for PC 290.018(b) failure to register as a sex offender. He was booked and released on O.R. for this felony charge.

In a press release about appointments issued minutes ago by California Governor Gavin Newsom's office, the first name was Susan Matsen.

No new charges for convicted sex offender and he will be out on the streets in less than a month

 


No new charges for convicted sex offender Ryan Landowski. On March 28, Landowski resolved his case and was sentenced to 135 days in jail. He has 85 days of custody credits. With more conduct credits, he will be out of custody in less than a month.

Jury trial for GOP vandalism suspect vacated for next week

On 3/28 at  trial confirmation for GOP vandalism suspect Michael Valls, Deputy Conflict Counsel asked for a continuance due to ongoing discussions. That request was granted. Trial setting is on 4/26/22

What do Pennsylvania, San Diego and other businesses have to do with this Humboldt case?

There are so many cross complainants and parties, including out of state businesses in this lawsuit. I recognize at least two Humboldt names. At the March 25 hearing, Judge Timothy Canning imposed sanctions in the amount of $5,000.

Judge Timothy Canning tenative ruling was to sustain the demurrer filed by the County with leave to amend in the lawsuit filed by Paul Leslie.

"After argument by attorneys, he took it under submission since he didn't realize the Board of Supervisors had told the real party in interest he couldn't keep the system and denied his appeal," said Ms. Allison Jackson.

The Department of Environmental Health was the initial contact with the real party of interest.

Interesting that in previous years, Hank Sims and Ryan Burns and Thad Greenson made a big deal about who Rob McBeth and certain other funders supported, yet this election season, there is zero coverage of the money behind the candidates this election. 

No charges filed for last year's arrest, what will be the outcome of the small claims case?

 


Michael John McBeth was arrested in November 2021 by HCSO for PC 496 d (a), receiving stolen property. He was released on O.R. The District Attorney has the report but no charges have been filed; the case is pending.

Mcbeth is being sued by Billy Wayne Hicks in small claims court for $10,000.

Phone scam with caller claim to be a HCSO Sergeant

The Humboldt County Sheriff’s Office has received numerous reports today of a phone scam targeting our community, claiming to be a Sheriff's Office Sergeant.

HCSO looking for "Muddy" wanted for attempted murder and other charges


 The Humboldt County Sheriff’s Office is seeking information regarding the whereabouts of Cody Benjamin Sides, AKA “Muddy”. Sides is wanted on multiple local and out-of-county warrants, including a felony warrant for Attempted Murder (PC 664/187) out of Trinity County. 

He was last seen in the area of Dowd Road, near Weitchpec, on March 26, 2022, fleeing from law enforcement. Anyone who sees Sides is urged to contact law enforcement immediately.


Why is EPD Detective Terry Liles on administrative leave?


Why is EPD Detective Terry Liles on administrative leave? Is that one of the corrective actions in the City of Eureka press relesse. Is he gone for 10 days or more? His Facebook page used to be public.

Once again  in my EPD text investigation coverage, I mentioned Liles.

On March 27, 2022, at about 8:36 a.m., a Humboldt County Sheriff’s deputy on patrol in the Blue Lake area conducted an investigation on an occupied vehicle parked in the parking lot of a business on the 700 block of Casino Way. Upon approaching the vehicle, the deputy observed an adult male passed out in the front seat of the vehicle, with a juvenile asleep in the back seat.

Convicted sex offender Gerald Moon arrested on several arrest and bench warrants for assault, criminal threats, burglary

 


Gerald Edward Moon was arrested by HCSO for arrest and bench warrants for PC 422 criminal threats, PC245(a)(1) assault with a,deadly weaon, PC12022.5(b)(1) personal use of a firearm during a felony, PC459/461(a) burglary, two probation/parole violations and a new charge PC290.012(a) failure to register as a sex offender.

Due to his probation violation, he is on a no bail status. That could and does change at or after arraignment, depending on the Judge.

Resolution, continuance or jury trial for Gary Cudney in April?

 


On March 23,  Gary Cudney had trial confirmation. Jury trial was confirmed for April 4 unless resolution is reached or motion to continue made at intervention. Cudney is the suspect in Dirty Dave's death.

Will Michael Acosta and Sarah Carroll get the same deal offered to Richard Haberman?

 


On March 24 Richard Haberman resolved his recent case with a lenient plea deal. Haberman entered a guity plea to Count 1 as a misdemeanor and the rest of the counts were dismissed. Haberman was sentenced to one year of probation and 8 days of jail time but given 8 days of custody credit.

The court minutes below are for the case in his jury trial. Deputy Public Defender Ben McLaughlin, one of Dues' attorneys told me, "The total sentence for Dues was 3 years, 4months.  He got 8 months consecutive for each felony VOP."

With Humboldt custody credits and if there are good conduct credits from prison or early release due to California's laws which constantly change, Dues won't serve the total time.

Why does the County have to be court ordered to turn over documents to media?

 


In 2018,Judge Reinholtsen ruled that the documents I requested from the County of Humboldt in the Cory Fisher case are not covered by the litigation exception. All other media benefitted when the County released those documents.

David Gene Couch was arrested yesterday by HCSO for PC 290.012(a) failure to register as a sex offender and VC 23152(f) driving under the influence of drugs. He was released on O.R.

I did two posts on Couch in July 2020. Couch told Courthouse security he would blow up the building and has been previously booked for felony charge of criminal threats and misdemeanor charge of resisting a police officer.

Dustin Latham rejects plea offer and wants his bail reduced


Hearing for assault suspect Dustin Latham  scheduled for 3/21 was continued to 3/24. Latham rejected the People's plea offer. On 3/21 Latham waived his right to a preliminary hearing.

Newsom appoints first openly transgender Judge on the Sacramento Superior Court


Today, Governor Gavin Newsom announced eight judicial appointments. This included "Andi Mudryk – the first openly transgender individual appointed to the bench in California – who will serve as a Judge on the Sacramento County Superior Court."

Central Station shooting suspect and former Humboldt CO resolves case with a plea with two major stipulations


On March 23, the day of his preliminary hearing, former Humboldt correctional officer and Central Station shooting suspect Sean Timothy O'Brien entered a conditional plea. Attorneys stipulated to a 10 year cap and $350,000 in victim restitution. More details below.

Sentencing is on 5/11.

Plaza bust results in arrests for meth and psilocybin mushrooms


On March 24th, 2022 special agents with the Humboldt County Drug Task Force (HCDTF), with the assistance of the Arcata Police Department (APD), and the Humboldt County Sheriff’s Office (HCSO) conducted an undercover buy operation in the area of the Arcata Plaza. This operation was in response to multiple community complaints of drug dealing on and around the plaza area.

Defense motion to exclude evidence from 2021 raid granted in Christie case

 


The hearing on the last defense motion about evidence from the 2018 Ray Christie case concluded this morning with some major wins for the defense and Christie including Judge Gregory Elvine-Kreis granting the defense motion to exclude evidence from the 2021 raid, hinting his ruling may help towards resolution and requiring the People to respond to future motions.

Kimberly Michelle Baird was arrested by Eureka Police Department yesterday for public intoxication. No booking photo because she was refused by medical and released.

She was arrested in February 2022 by Eureka Police Department on a bench warrant for VC 23578 enhanced DUI penalties for excessive blood alcohol count, VC 23152 (b) driving with a blood alcohol content of 0.08% Or more and VC 23152 (a). Baird was released on OR.

Humboldt one of 16 counties in Newsom's state of emergency proclamation

"This is not the first time the People have failed to oppose an important motion in a timely fashion.  Most times they don’t respond at all.  They wait until the scheduled hearing to finally reveal their position, utilizing an inappropriate “trial by ambush” tactic."

 




There is a hearing on a defense motion in the Ray Christie case about evidence seized in the 2021 raid. I have been checking on the case. The hearing is scheduled on 3/24/22 as requested.

Last I checked this week, the District Attorney's office had not filed any response. The last filing by DA was on March 10.
