Felon arrested by EPD yesterday, also has 2017 and 2012 arrests


Felon Anthony David Maillelle was arrested by Eureka Police Department yesterday for criminal threats. He was arrested in 2017 by HCSO for obstructing/resisting a police officer, violation of probation.. In 2012, he was arrested by EPD for for reckless evading, resisting arrest, DUI, vehicle theft, and parole violation.

This is the stipulation order for the resolution of a federal civil lawsuit filed by the Civil Liberties Defense Center against Humboldt County and two HCSO deputies.

Still waiting on a response from HCSO and from District Attorney Maggie Fleming.

County enters into another lawsuit settlement

 The California Attorney General (AG) and the Humboldt County Department of Health & Human Services (DHHS) jointly submitted a request Thursday to the Humboldt County Superior Court to enter into a proposed stipulated supplemental judgment that intends to fully resolve all outstanding compliance issues relating to the prior 2018 stipulated judgment over DHHS’s Child Welfare Services Division (CWS). 

"I submit this to you, John, in the hopes that your diligence as a reporter and truth-seeker will bring some of this to light. "

I write this letter needing anonymity, as I am a current Eureka Police employee and do not desire to have my life upended in the manner that other officers have had recently.  

I - and pretty much every other Eureka officer - am grossly disappointed in the Sac Bee's several recent articles impugning the integrity of the department and the integrity of the officers involved in the (Bee's self-proclaimed) "texting scandal".  More upsetting to me though, is the fact that Bee clearly did zero due diligence in investigating the claims reported to them by this so called "anonymous source", who was using the Bee to generate publicity to distract from his own grievous and criminal wrongdoings.  That source, incidentally, is Eureka Police Officer Matthew White - this is known to everyone here, and it's no surprise given his history.

Livestreams in the two problem courtrooms started on time today, the Judges running and attorneys running late were on time. Calendars were consolidated in courtrooms that had trials scheduled.

Attorneys found out this morning that "no defendants were being brought down in the Zoom room for the 8:30 calendar" this morning.

Only one defendant is being brought down at a time. While this slightly delayed the court calendars for a while, things went smoothly. 

Gee, wonder why these changes were instituted?

Cause of vegetation fire on 400 block of Ole Hansen Road under investigation


On May 26, 2021 at 11:11 P.M. a single engine from Humboldt Bay Fire was dispatched to a reported vegetation fire, several trees burning, on the 400 Block of Ole Hansen Road, between the Freshwater and Indianola areas.

CLDC attorneys released a statement about a resolution of a federal civil lawsuit in which they represent Mike Gamms.

I have contacted the County and District Attorney Maggie Fleming for a response. It is after business hours and I will add any response to the post. County referred me to HCSO on May 27. I contacted them.

Opening statements were scheduled in alleged rapist and former HSU student Darrius Upshaw's court trial. John Doe #1 and John Doe #2 were expected to testify. Instead there was a delay after motions in limine and an additional witness.

On May 25, 2021, Detectives with the Eureka Police Department’s Problem Oriented Policing Team (POP), with assistance from the Humboldt County Drug Task Force (DTF), served a search warrant on 42-year-old Michael Wade Thielen at a hotel on the 200 block of 5th Street in Eureka.

Preliminary hearing for murder suspect Connor Whited was rescheduled for May 26. It has been continued several times due to lack of courtrooms.

On May 25, 2021, at about 9:46 p.m., a Humboldt County Sheriff’s deputy on patrol in the area of Central Avenue and School Road, in McKinleyville, observed a vehicle stopped in the middle of the roadway.

Acosta a no show for court

 


Convicted felon Robert Cullen's attorney Michael Acosta was a no show. Clerk in Courtroom 3 emailed Mr. Acosta. 45 minutes later, Retired Judge John Feeney continued the  hearing to tomorrow.

Humboldt remains in orange tier despite the highest stats in California

Seven new cases of COVID-19 were reported in Humboldt County today out of 73 total tests run. 

"Developing offshore wind to produce clean, renewable energy could be a game changer to achieving California’s clean energy goals and addressing climate change – all while bolstering the economy and creating new jobs"



The $11 million for Port of Humboldt was mentioned in a previous post on May 19. Today, Governor Gavin Newsom sent out a press release on California's clean energy goals.

HSU, Chi Phi, unofficial event with alcohol and alleged rape involving fraternity members

 


Court trial for Darrius Upshaw started today. It did this morning with motions in limine. 1108 evidence will be allowed.  Upshaw is ineligible for probation.

Upshaw, the two alleged victims and two potential witnesses were all members of the Chi Phi Fraternity at HSU. Another unofficial event at an off campus house with alcohol, an alleged crime that ends up in court. Chi Phi was suspended in 2015.

Nine years prison term for Franklin Molina


Kidnapping, robbery and assault suspect Franklin Molina was finally sentenced today according to the negotiated disposition. 

Yesterday we waited 45 minutes , today courtrooms running late

Oregon warrant, similar charges and text messages about possible marijuana sales raised at bail hearing

 


Alleged rapist Timothy Miller-Roberts' OR/bail hearing was continued to this morning and "put over" to tomorrow for additional information from Oregon. Bail is $75,000.

COVID, Humboldt courts and jail is hell

 


Preliminary hearing for molestor Jorge Alcazar Vasquez was scheduled for May 24. It was rescheduled for July 21.

Pawlyk refused to come to court, "because he is fearful to leave the jail cell because he maybe killed on the way to court."

 


James Pawlyk refused to come to court; again and twice today. An entire day wasted until this afternoon when Judge Kaleb Cockrum did what is obvious. Criminal proceedings are suspended. Dr. Wilson has been appointed to evaluate Pawlyk.  Will he agree and be seen by her?

Blair Angus retired and Natalie Duke is still employed with the County Counsel's office. Only I have covered that disciplinary charges have been filed against Angus and Deputy County Counsel Natalie Duke in State Bar Court. This is for the Magney lawsuit.

Robert Clouse arrested for child molestation and indecent exposure


Robert Alexander Clouse was arrested by the Eureka Police Department on a Ramey warrant for PC 314 (1) indecent exposure and PC 288 (a) lewd or lascivious act on a child under 14.

This is the second tip I have received about a EPD Sgt and sexual harassment

 


I received this letter today from someone who identifies as "a person in Eureka." It was post marked May 19. 

The EPD letter above is very specific. These are very specific and detailed allegations. I have sent it to EPD Chief Steve Watson. If he replies, I will publish that response separately. I have also sent it to the City of Eureka and asked them for a second time  the status of the EPD texts investigation. The first follow up was in April.

Eureka City Manager Miles Slattery responded, "Unfortunately John, nothing new to report as of yet."

Last two days Pawlyk refuses to come to court and causes needless continuances


James Pawlyk had his probable cause hearing scheduled today and parole revocation hearing on June 8. His probable cause hearing was continued by Judge Christopher Wilson to May 24 because he refused to come to court.

$11 million in CA budget for Port of Humboldt Bay

The  Port  of  Humboldt  Bay,  managed  by  the  Humboldt  Bay  Harbor Recreation  and  Conservation  District, will be  recipient of  $11  million  to  be  used  as  matching  funds  for a  $55  million  Port  Infrastructure Development  Program  grant  application  which  is  due  on  July  30th.

Timothy David Miller-Roberts preliminary hearing did not conclude yesterday because he was in "medical distress." It was continued to this afternoon. Whatever his distress was, he seemed fine today.  He threw up  his hands up in the air during arguments. Apparently, Miller-Roberts thinks redness in the vagina of the 14 year old he is accused of raping is normal and he is the victim.

Once again, it was continued for the same reasons and excuses we have heard from the defense for several hearings. At the last hearing, it had been 7 months since Dare's conviction.

Roger Samuel Barisdale was arrested by Rio Dell Police Department yesterday on a bench warrant for PC 290.013(a) failure to register as a sex offender and new arrest for PC 240 asault, PC 242 battery, PC 422 criminal threats and PC 243 (e) (1) domestic battery.
