Career criminal with 43 cases lies to the court, gets exposed with facts, doesn't deserve the attorney he has or the plea he was offered by the DA

 

There is no rehabilitating a career criminal who is unrepentant, lies, refuses to take responsibility or change.

Looks like the City of Eureka's lack of response will result in another petition and CEQA lawsuit, this time about the 5th and D parking lot

Rio Dell alleged molestor with 4 victims rejects DA's plea offer of 55 years

 

Four Jane Does, all minors are alleged victims of Daniel Lloyd Sanchez who is charged with 17 counts including forcible rape, aggravated sexual assault of a minor, rape of a conscious victim and lewd acts with a minor.

Jury trial for another alleged molestor scheduled to start next week

 

Alleged molestor Matthew Dickerson's jury trial will not start on 5/1 as scheduled. Deputy Public Defender Ben McLaughlin filed a motion to disqualify Judge Hinrichs on 4/21 after trial assignment last week.

Deputy District Attorney Whitney Timm's current trial is expected to end next week. The trial has been assigned to Judge Steven Steward.

Cody Shore arrested a month later after plea on a warrant for weapons on a school ground case

Cody Arthur Shore has 9 cases in the Humboldt Superior Court system. Yesterday, the Arcata Police Department arrested him on a bench warrant for PC 626.10(a)(1), weapons on a school ground in one of his two 2022 cases.

California State Parks and the Cher-Ae Heights Indian Community of the Trinidad Rancheria (Trinidad Rancheria) signed a historic 5-year memorandum of understanding (MOU) between the tribe and State Parks on Monday, April 24. 

Austin Medeiros found guilty of all charges including first degree murder

Homicide suspect Austin Medeiros found guilty of all charges and all special allegations were found true. Jury deliberated less than a day. Sentencing is on 5/24/23.

No response from City of Eureka on lawsuit filed by Citizens for a Better Eureka

 

It has been more than three weeks since the City of Eureka was notified of the lawsuit filed by Citizens for a Better Eureka. 

Former court mediator and victim advocate files for restraining order against attorney Eddie Schrock

 

Former court mediator and Velda Gooden filed a request for a civil harassment restraining order against local attorney Eddie Schrock. Both are pro per.

In February 2023, I reported Gooden had been let go by Humboldt Superior Court. Gooden left her job as a former Victim Witness Advocate and took over court mediation after former court mediator Joe Hale was arrested for criminal invasion of privacy. Gooden previously worked for DHHS as a Vocational Counselor.

With no reason given, Joe Hale's arraignment continued at the last minute to next month

 

If you have not been reading my updates and developments on former Humboldt court mediator and former CWS employee Joe Hale, you should since the information has only been reported here. I just did a post on 4/25 about protective order in Hale's case where a duplicate of actual photographs and videos will be provided to defense in discovery.  That protective order states Hale's case involves the "alleged surreptitious taking of photographs and/or videos of several female undergarments and intimate parts of their bodies."

State uses eminent domain to enter one of Ray Christie's properties in Arcata

Retrial of rancher Ray Christie's 2018 animal cruelty case is scheduled for August. While looking up all of Christie's cases in Humboldt Superior Court, I saw he had a conviction for speeding in September last year, guilty in absentia. And then I saw entry of judgement and an eminent domain petition for a property in Arcata belonging to him and Jennifer Christie. No attorney listed for either case.

After waiving her right to appeal, one of the Manila 5 wants to be resentenced

 

There is not a whole lot of information in the computer except for court minutes from 4/19 but one of the Manila 5, voluntary manslaughter suspect Tamara Nicole Thomson, is petitioning the court for resentencing. She had waived her right to appeal.

Man with gun violence restraining order arrested for the fourth time in 5 months

James Leach already had three arrests, two open cases and a gun violence restraining order. He was arrested for the fourth time yesterday by Eureka Police Department last night.

Convicted sex offender with 57 cases held to answer for two acts of indecent exposure in Arcata

I did a post on convicted sex offender Daniel Balridge in 2019 when Eureka Police Department arrested him for failure to register. He has 57 cases in the Humboldt Superior Court system.

Yesterday, Baldridge had two cases on calendar. I covered the preliminary hearing for the case where he was charged with two counts of indecent exposure. After the preliminary hearing, Judge Joyce Hinrichs  held Baldridge to answer on both counts. 

Other than custody credits, victim impact statements, there was no new information to cover in this sentencing

I did not cover convicted felon Jared Aubrey sentencing today because the plea deal was a stipulated term of 43 years to life. Other than victim impact statements and custody credits, there was no new information in court today. 

Aubrey told Judge Kelly Neel he did not say the gun he used was his brother in law's weapon. He was sentenced to 43 years, 8 months to life. Aubrey has 279 custody credits.

Humboldt Superior Court rejects Michael Acosta's 995 motion because there was no OST

 

Local Michael Acosta's Faretta motion was rejected on March 7 but he can resubmit it. Currently, he has a court appointed attorney, Ms. Rebecca Linkous, but he went ahead and filed a 995 motion on his own for his case. 

It was rejected by Humboldt Superior Court because it was not filed with a Order Shortening Time. I have a copy of the entire motion and am going to wait and see if Acosta files it.

Same guy from Sunday has two HCSO deputies searching garage, broke into elderly owner's house

 

 Kudos to HCSO deputies on Sunday & again today, especially Sgt. Krystle Arminio being proactive. Thanks to HCSO an elderly home owner & Myrtletown neighborhood are safer. Family members are here talking to deputies and so you are getting live and exclusive coverage. 

HCSO was just here on Sunday with 6 patrol cars and a canine unit. The guy was cited. Since then he has been a nuisance. Later on 4/24 after HCSO left and again today, this crazy guy has his vehicle pulled out on the sidewalk, blocking people walking and was muttering to himself, slamming things.

Who knows when we will get an update on the two gun happy, yahoo Widmark brothers who went on an assault and shooting spree all over town or the investigation into the OIS at Harris and Dolbeer.

HCSO has been busy and is now more short staffed because of two irresponsible punks raised in a drug ridden, gun totin County. Don't preach the 2nd amendment to me when it involves trigger happy criminals, who endangered many lives, injured people ,wasted resources and forced law enforcement into shooting to protect the public. If Brandon Widmark had been remanded for his 2022 assault case as the DA asked, maybe this incident could have been avoided.

Closing arguments today, deliberations tomorrow in Kneeland homicide case barring any last minute twists

 

On 4/24,  after People and defense both rested their case and People offered no rebuttal, jurors in the Austin Medeiros homicide case are scheduled to start deliberations tomorrow after final jury instructions.

Former Humboldt court mediator and former CWS employee Joe Hale is scheduled to be arraigned this Friday in misdemeanor court. A waiver of personal appearance was filed by Hale's attorney, Mr. Paul Gallegos so he does not have to be present in court. Mendocino Assistant Deputy District Attorney Dale Trigg is the prosecutor for the case.

In former Humboldt Deputy Public Defender Rory Kalin's lawsuit against Humboldt Superior Court Judge Gregory J. Kreis, current Public Defender Luke Brownfield and former Public Defender Marek Reavis, there was a demurrer filed by Brownfield and Reavis to the 15th and 16th causes of the third amended complaint.

In a ruling yesterday, Mendocino Judge Ann Moorman sustained that demurrer to those two causes of action without leave to amend. This demurrer pertains only to the County of Humboldt and Public Defender's office.

Mother hides convicted molestor parolee, he cuts off ankle monitor and is back in Humboldt jail

 

Dylan Jackson Wilson was booked into Humboldt jail today on a felony parole violation. He was arrested by state parole on a foreign warrant from Stockton for a parole hold.

A regular reader of my blog told me, "Dylan's mother Dana Holcomb was hiding him at her home. He was released from prison on April 19. Cut his ankle monitor off and has been hiding at his mothers home. "

Not only did Lost Coast Outpost put a byline on sloppy post that mostly lists work from other sources including a two year old press release from Emerald Farms, they continue their petty, childish omission denying something I wrote last July. My post was original reporting with court documents. 

On 4/25 there is an ex parte hearing regarding defendant's substitution of counsel Emerald Family Farms LLC, Patrick Murphy, Tanja Baker and Humboldt HealthCare LLC. That motion was granted. Hearing on auction sale of assets is scheduled for 4/26 with a case mananagement conference on 5/22. Court minutes from 4/26 posted below.

On April 23, 2023 at approximately 11:30 p.m., the Eureka Police Department received information of a traffic collision off the Eureka Waterfront Trail near the Tooby Road parking area.  

No signs of suspicious activity or foul play in Fairfield deaths

On April 21, 2023 at approximately 12:05 p.m., officers with the Eureka Police Department (EPD) were dispatched to the 2700 block of Fairfield Street to conduct a welfare check on the occupants of the residence.  

Alleged victim in HCSO Lt. incident has his own criminal record

The alleged victim in the incident that led to the arrest of HCSO Lt. Samuel David  Williams is Brian Edward Kelsey Jr. The name sounded familiar so I checked out court records. There are atleast two criminal cases for Kelsey, Jr. that I could verify with full name in court records.

A year later, Bryan Maggio was arrested again;  this time by HCSO. He was booked for PC 23900 altering a firearm, PC 24610 possession of undetectable fiream, PC 33215 possession of a short-barreled rifles or sawed-off shotgun,  PC 30305(a) possession of ammunition by a prohibited person, PC 29800(a)(1) felon in possession of  a firearm and HS 11351 possession of a controlled substance for sale.

While sitting at trial assignment for two other cases, I heard arguments on a defense motion to dismiss Randall McCoy's case. 

No court, both attorneys busy delays trial for man charged with molesting his cousin

 

At trial assignment yesterday, after Judge Joyce Hinrichs said, "Realistically we cannot get to time waived matters this week," alleged molestor  Christian Bautista-Ramirez jury trial scheduled to start on Monday was vacated. He is out of custody, another factor that puts his case on the bottom of the pile. There was no court available for Bautista-Ramirez's trial next week. Both attorneys' schedules were also a factor.

On this Tuesday, April 25 Board of Supervisor's meeting, under closed session, the 2022 lawsuit filed by  Mercer Fraser Company against the County of Humboldt is listed. I have been checking on the status of that case and there has been nothing significant happening except the case being dragged out at cost to the taxpayers.

On 4/14, the motion filed by the DA to consolidate both cases for alleged molestor Matthew Dickerson was continued to 4/21. The jury trial date of 4/17 was vacated and rescheduled for 4/24.

Charges amended right before Kneeland homicide jury trial started this month

 

Jury trial for homicide suspect Austin Medeiros is on the 10th day on 4/21.  Deputy DA Candace Myers is the prosecutor. Deputy Conflict Counsel Owen Tipps is Medeiros' attorney. The charges were amended in April 2023.

DA only charges 20 year old with rape charge, not sexual battery

20 year old alleged rapist Ethan Erik Halseth was booked on two charges but the DA has only charged him with one count PC 261 (a) (4), rape of an unconscious victim. Arraignment is on 5/25.

Lonyx Landry was appointed by Fourth District Supervisor Natalie Arroyo to the Planning Commission this year.

At the April 6 meeting approximately 36 minutes into the meeting, Humboldt Building and Planning Director John Ford tells Commissioner Landryx that he needs to disclose "private communication provided to you that has not been provided to the rest of the Commission or staff and that has completely caught us off guard."

At today's meeting's meeting there is an agenda item on ex parte disclosures and public records.

Brandon Widmark has an assault case, the alleged victim is the father of the woman he is in a relationship with?

 

Brandon Widmark, the older brother and one of the suspects taken into custody near Harris and Dolbeer has two criminal cases and two family law cases. According to his Facebook profile he is in a relationship with a third woman, the daughter of the victim in his assault case.

HCSO lieutenant arrested for criminal threats and exhibiting a firearm?

Samuel David  Williams had an arrest warrant issued on 4/18 for Ct 1 PC 422 criminal threats and  Ct 2 PC 417 (a) (2) (b) exhibiting a firearm. Alleged victim Brian Edward Kelsey Jr. He was arrested today and already bonded out, bail was $25,000. Arraignment is on 6/1.

I am pretty sure that is the HCSO detective who was promoted to Lieutenant. I contacted HCSO PIO Samantha Karges.  HCSO press release issued at 1:16 added to the post.

Convicted sex offender already out of prison and arrested for failure to register

Lance Wayne Marshall was arrested by HCSO yesterday for PC 290.012(a), failure to register as a sex offender.

Marshall was convicted in 2020, he entered a plea in case to PC 288 (a) lewd or l ascivious act upon a minor and was sentenced to 6 years.

Another case involving Humboldt courts assigned to Mendocino Judge Moorman

On 4/18, Mendocino Assistant Deputy District Attorney Dale Trigg filed 170.6 disqualification against Mendocino Judge Carly Dolan supposed to hear in former Humboldt court mediator Joe Hale's case. Hale previously worked for CWS. Parties stipulated Mendocino Judge Ann Moorman will hear the case.

Judge Moorman is also assigned to former Deputy Public Defender Rory Kalin's case against Humboldt Judge Gregory Kreis, current Public Defender Luke Brownfield and former Public Defender Marek Reavis. 

Human remains found near Eel River identified as 37 year old Garberville woman

On April 18, 2023, around 7 p.m., the Humboldt County Sheriff’s Office Emergency Communications Center received a call regarding human remains found in the South Fork of the Eel River, north of Garberville.
