Man with gun violence restraining order arrested for the fourth time in 5 months

James Leach already had three arrests, two open cases and a gun violence restraining order. He was arrested for the fourth time yesterday by Eureka Police Department last night.

Leach had a bench warrant issued on 4/11 after he failed to appear in court. His bail is currently $250,000. Previous bail bonds were forfeited.

Leach is scheduled to be arraigned on his warrant this afternoon with a hearing on his bond status. 

At arraignment Leach interrupted Judge Steven Steward twice and had to be cautioned both by Judge Steward and the bailiff only to speak via his attorney. 

"So, uh,your honor. I missed the court date because I was chased off the Bay with knives," said Leach.

Referral to supervised release at request of defense. Bail hearing on April 28. Preliminary hearing rescheduled to May 8.

Leach was previously arrested on January 26 2023, January 7 2023 and December 8 2022. He has one EPD case and one HCSO case. They are to be consolidated after his preliminary hearing.

4/28: At his OR/bail.hearing today, once again Leach went off with his knives claim and embellished the story more to Public Defender Luke Brownfield who was in court today for his office. Leach said, "I got two things wrong. I will never do anything wrong. 

Mr. Brownfield said, "I ask Mr. Leach be released on  the supervised release program. His score is 4 which is mid level. He goes into his friend's house believing they are in danger. This is not first degree residential burglary."

Deputy District Attorney Ian Harris said, " I am not here to try the case. The People disagree with Mr. Leach's intent." Mr. Harris mentioned strike offenses, Leach being a flight risk, Leach's failure to appear and him being a danger to the community.

"The Court needs to take these allegations as true," said Judge Steward. He said he has to evaluate whether to release Leach and weigh in several factors. "These are serious, violent felonies, particularly in CR2300153. Probation recommends against release. Public and victim safety are of concern to the Court. Supervised release is denied at this time." 

5/8: Deputy District Attorney Trent Timm was in court today. He is the prosecutor for both of Leach's cases.  Deputy Public Defender Casey Russo was home with a sick child. Leach had two extra bailiffs in court watching him. Leach spoke with Public Defender Luke Brownfield and ranted about harassment, security, shooting. "There are no voices. I know what is going on. You guys can release me and I will be back for my court date."

Mr. Brownfield asked Judge Joyce Hinrichs to approach the bench. After discussion with Mr. Timm and Judge Hinrichs, the case was continued for setting of preliminary hearing on 5/10. 

5/10: Deputy Public Defender Casey Russo told Judge Kelly Neel he was declaring doubt. Criminal proceedings were suspended for Leach. Dr. Kelly was appointed. A 1368.1 probable cause hearing is scheduled for 5/22. Receipt of Dr. Kelly's report is due 5/30. Deputy DA Candace Myers appeared on the case for the People.
