Defense in murder suspect Jason Miller's case had filed a 995 motion. Arguments on the motion had been continued twice. Offers had been made by both parties.
Ms. Andrea Sullivan was asking to set aside charges and vacate the information. Deputy District Attorney Roger Rees opposes the request to dismiss Count 1 and the special allegation.
Today, Ms. Sullivan told Judge Hinrichs, "We are very close to finalizing a resolution" and asked the 995 date for today be vacated. Change of plea is scheduled for May 2. Miller's assault case is trailing.
Trial confirmation is scheduled for 5/11; jury trial for 5/30. Deputy DA Wayne Phillips appeared in court for Deputy DA Roger Rees.
