No court, both attorneys busy delays trial for man charged with molesting his cousin

 


At trial assignment yesterday, after Judge Joyce Hinrichs said, "Realistically we cannot get to time waived matters this week," alleged molestor  Christian Bautista-Ramirez jury trial scheduled to start on Monday was vacated. He is out of custody, another factor that puts his case on the bottom of the pile. There was no court available for Bautista-Ramirez's trial next week. Both attorneys' schedules were also a factor.

Deputy District Attorney Whitney Timm is currently in trial. DA Stacey Eads appeared on the case for the People.

Bautista-Ramirez's attorney, Ms. Andrea Sullivan told Judge Hinrichs, "I have a very serious lifetop case to get out in Humboldt. We need Ms. Timm to reschedule. Both of us are very busy."  Trial setting was scheduled for May 10.

There was an intervention on 3/15 with Judge Kaleb  Cockrum that did not result in any resolution. The alleged victim is Bautista-Ramirez's cousin.

5/10: Trial confirmation is on 9/13; jury trial on 925.

9/13: Trial confirmation continued to 9/18.  Defense is waiting for 288.1 mental health report for sex offenders. The evaluation was completed a month ago.

9/18: Trial confirmed on 9/18 but defense still waiting for the 288.1 report. Time estimate two weeks.

9/21: At trial assignment, resolution "forthcoming"; 9/25 date vacated. Change of plea scheduled for 10/5.
