Jury trial for another alleged molestor scheduled to start next week

 


Alleged molestor Matthew Dickerson's jury trial will not start on 5/1 as scheduled. Deputy Public Defender Ben McLaughlin filed a motion to disqualify Judge Hinrichs on 4/21 after trial assignment last week.

Deputy District Attorney Whitney Timm's current trial is expected to end next week. The trial has been assigned to Judge Steven Steward.

At trial assignment today, the ruling on motion to consolidate both of Dickerson's cases will be heard by Judge Steward. The second case is Dickerson disobeying a court order. In his molestation case, Dickerson is charged with 8 felony counts which include unlawful sexual intercourse, sexual penetration and lewd acts with a minor. Dickerson had waived his preliminary hearing.

Attorneys will meet with  Judge Steward on 5/2. Individual jurors will probably be questioned starting 5/3. Time estimate is 3 weeks including jury selection.

Defense intends to call a DNA expert and Dickerson is expected to take the stand.

5/2: Motion to consolidate cases granted by Judge Steward.

5/8: Lengthy explaination on his rulings by Judge Steward. Defense motion to disniss denied. Defense refused curative measures for discovery so Judge Steward declared a mistrial. Judge Steward said there was explaination for late discovery. It was oversight; not intentional or reckless. Trial setting on 5/11. 

5/11: Hearing on 5/17 for re-referral to supervised release. Trial confirmation scheduled for 6/12; jury trial on 6/20. 

5/17: Hearing continued to 5/18.

5/18: Supervised release denied. Disobedience of court order case continued by court to 6/12 hearing on status of case. Count 1 pertaining to Dickerson was previously consolidated into his molestation case. DA will file amended information in molestation case and the 2023 disobedience matter in that case will be dismissed.

Trial confirmation on 6/12 for molestation case; jury trial on 6/20. Defense disqualified Judge Joyce Hinrichs. Judge Kelly Neel recused herself.


6/12Dickerson disobedience of court order was trailing his molestation case which was on for trial confirmation today. Deputy Public Defender Ben McLaughlin had filed a motion to dismiss according to PC 1382 in Dickerson's molestation case. Nothing was stated on record about that but Mr. McLaughlin agreed to hold off on his motion to continue the 6/20 trial or have Dickerson enter a time waiver. Deputy District Attorney Whitney Timm is currently in trial, scheduled to start a two co-defendant, with time not waived on 6/26 with a 25 day time estimate. Mr. McLaughlin is out of the country for 3 weeks when Dickerson's trial is scheduled to start. Dickerson's trial will trail and depending on what happens with the two co-defendant trial, there maybe a motion to continue.

Count 1 from the disobedience of court order case has been added to the other case in amended information and that 2023 case was dismissed. 

6/16: Dickerson enters time waiver. Defense motion to continue granted. 6/20 date vacated. PC 1382 motion scheduled for 7/12; jury trial on 7/17.

I am not covering Dickerson's co-defendant in the disobedience of court order case.

7/12: PC 1382 motion to dismiss continued to 7/14 which is also trial assignment.

7/13: Motion to continue by PD was granted. 7/14 date and 7/17 jury trial vacated. Trial setting and motion to dismiss scheduled for 7/27. 

7/27: Trial setting and motion to dismiss continued by defense since Mr. McLaughlin is still waiting for Dr's report.

8/23: Trial setting + motion to dismiss continued by defense to 9/7. Expert witness availability not known. 2 hr time estimate.

9/7:  Trial confirmation and motion to dismiss on 10/16; jury trial on 10/30.

10/6: Case was on for setting of Motion to dismiss + Trial assignment. Motion to dismiss continued by stipulation to 10/9 when jury trial is scheduled to start. Assigned to Judge Kaleb Cockrum but will be moved to another courtroom instead of Courtroom 2. Defense has subpoenaed records from St. Joes.

10/9: Motion to dismiss + jury trialcontinued to 10/11.
