Former dairy farmer, now disabled says attorney might file injunction to shut down the Fairgrounds

 


It is predictable what First District Supervisor Rex Bohn and Second District Supervisor Michelle Bushnell, Humboldt Public Director Tom Mattson and good ole boys and gals like Andy Titus and Cindy Olsen associated presently or formerly with the Humboldt County Fair would say this afternoon. The dog and pony show of certain people showing up to speak at these meetings does not fool anyone who knows how politics are done.

Jury selection had been going on since June 1. It took but finally on 6/26, a  jury was sworn in alleged molester Frederick Bernard Adams. The time estimate for the entire trial was 25 days; it took that long to select a jury.

"Two of the Humboldt Superior Court Judge positions with be on the ballot during the March 2024 Presidential Primary. They will then be seated in January 2025."


I contacted Humboldt County Elections office. "Two of the Humboldt Superior Court Judge positions with be on the ballot during the March 2024 Presidential Primary. They will then be seated in January 2025."

One of those positions is Judge Gregory Elvine-Kreis who was not elected but appointed. The other one  for Judge Lawrence Killoran's position. Judge Joyce Hinrich's name has been brought up around the courthouse cooler. She is up for re-election in 2026.

Courthouse, courts open July 3, most County offices closed

The Humboldt County Board of Supervisors yesterday approved the closure of many public-facing county offices on Monday, July 3. This closure is in addition to the previously scheduled July 4 closure.

Kyle Zoellner's mother arrested again on meth and other drug charges


Monika Luise Wissel was arrested by Eureka Police Department on an arrest warrant yesterday for HS 11377(a) possession of meth, HS 11366.5(a) maintaining a drug storage location and HS 11351 possession  of a controlled substance for sale. She was released on O.R. She is Kyle Zoellner's mother. I have covered her cases since 2016.

Did Kreis gyrate his hips with Kalin's wife? His response to that and other allegations of infidelity and harassment including confidential settlement of a court employee in lawsuit filed against him by Kalin

Today, there is a case management conference in former Humboldt Deputy Public Defender Rory Kalin is suing Kreis as well as current Public Defender Luke Brownfield and former Public Defender Marek Reavis. I will update with Mendocino Jude Ann Moorman's rulings on several motions.

When I did my last post, a statement to compel responses by Kreis had not been filed. Read some excerpts for yourself. The way it comes across is Kreis wants the public to believe his public defender buddies and others partying with him on that boat but news articles, other attorneys and everyone else is lying? This is a small community and plenty of people have their own experience with Kreis. He is divorced. I did a post in July 2020 which has the Shasta County Sheriff's report.

Check out the booking photo and name in the post I did on June 16. How many names does Vonda Joyce Liles have? The jail log lists her name as Vonda Joyce Carlson for these new charges as well as bail surrender in her curent co-defendant case for PC 32.

I contacted HCSO PIO Samantha Karges, "Yes, it looks like she goes by a few different names. Liles is the last name she went by in this latest interaction with deputies, but she was booked under Carlson for continuity in the jail."

$12,361,918 million for Humboldt County, Mad River Hospital, CalPoly Humboldt and City of Arcata project

State officials announced today the award of $12,361,918 million in a unique partnership between Humboldt County Behavioral Health, Mad River Community Hospital, Cal Poly Humboldt and the City of Arcata. The funding will be used to build a Behavioral Health Crisis Triage Center. 

Judge dismisses former court mediator lawsuit against Eddie Schrock

 



If you have been reading my coverage on former court mediator Velda Gooden against local attorney Eddie Schrock, you will understand why I chose not to waste my time this morning. The result was exactly as I expected.

I have covered Michael Acosta and Sarah Carroll's case regularly and recently been the only one to cover in court and with documents. There were a lot of repetitive arguments this morning on Acosta's 995 motion; motion to compel, request for judicial notice and motion to qualify the DA. 

Acosta sent me some more information this morning including a potential joinder motion by Carroll. His email to the DA alone is worth reading.

CA Supreme Court new rule requires attorneys to report criminal act and other misconduct by other CA lawyers



The California Supreme Court has approved a new rule of professional conduct, rule 8.3 of the California Rules of Professional Conduct, that requires California attorneys to report any lawyer who commits a criminal act, engages in fraud, misappropriates funds or property, or engages in conduct involving “dishonesty, deceit, and reckless or intentional misrepresentations.”

Yet, another Mexican restaurant gives it a go at this 5th street location


Los Sinaloense used to be located at 1134 5th street in Eureka. It is now Paco's Taco Taqueria. Owner is Alfa Torres Leon. There is an application for a new license to sell beer and wine. I had previously reported about this location being for sale. Many Mexican restaurants have been open at this location.

DA finally responds to Acosta's allegations with a tepid response

 


Deputy District Attorney Ian Harris finally filed a response to Michael Acosta's 995 motion. It certainly was not worth the wait. Acosta's reply to the DA includes some information he has alleged before. Let's see how Associate Justice Stuart Pollak rules on Acosta's 995 motion, request for judicial notice,  motion to compel discovery and motion to disqualify DA.

27 year old with a record arrested for criminal threats, assault, grand theft of a firearm and probation violation


Riley Kai ClarkWalkner was arrested on an arrest warrant by CalPoly HSU PD yesterday. Charges include PC 422 criminal threats, PC 602.5  aggravated trespass, PC 1203.2(a)(2) probation violation, PC 487(d)(2) grand theft of a firearm and two counts of PC 245(a)(1) assault. He has four cases in the e court system with a dismissal in one case.

John Curtis Lewis was booked into jail yesterday on an arrest warrant for PC 422, criminal threats. This charge  is from his third 2023 case.

Jury finds Sergio Lozano guilty on 8 of 9 counts

 


Alleged molestor Sergio Reynoso Lozano jury came back with a verdict around 10:52 this morning. The jury found Lozano guilty on 8 of 9 counts. They could not agree and the verdict was "hung 10-2 for guilt on count 8."

I did a detailed breakdown in my last post about the notes and deliberations. The jurors had taken three previous votes on Count 8. Sentencing is August 4. Lozano still faces 50 years to life.

Kidnapping and rape suspect held to answer after preliminary hearing

 


Kidnapping and rape suspect Shannon Campbell had his preliminary hearing yesterday. People had four law enforcement witnesses which included two HCSO deputies, one CHP officer and one Fullerton PD officer. Campbell was held to answer. Arraignment on information is on 6/29.

So many criminals; not enough time. Humboldt criminals multiply faster than a rabbit. Factor in the constant backlog, continuances and jammed up local courts with inefficient court admin and the last two Presiding Judges and staff shortage hemorrhaging faster than a wound at the ER, I had forgotten about this duo. Until this week when I was stuck in court for hours.

Former court mediator Velda Gooden is suing local attorney Eddie Schrock. The latest in this ongoing drama case is that Gooden has subpoenaed Ryan Weinert. Schrock is representing the other party in Ryan Weinert's family law case. Schrock subpoenaed Humboldt Superior Court CEO Meara Hattan who has filed an objection to her personal appearance and production of documents.

Another convicted felon, frequent offender arrested and clogs up the local jail

Convicted felon Cody Bryan Wuillmier was arrested by HCDTF yesterday. Most of HCDTF arrests are repeat offenders and those with warrants.  It isn't Wuillmier's first time in custody and it will not be his last. I previoisly posted about two of his arrests, one from 2022 and one from 2016.

Mr. Patrik Griego is Humboldt Judge Gregory Kreis' attorney. Former Humboldt Deputy Public Defender Rory Kalin is suing Kreis as well as current Public Defender Luke Brownfield and former Public Defender Marek Reavis. In a motion to compel defendants want Kalin to submit to independent medical examinations. Defendants also call Kalin a drug user and an opportunist.

Former baseball coach's alleged molestation case likely to resolve just as I expected

 


Former baseball coach and alleged molestor Benjamin Pesch's trial confirmation this morning was continued to June 21 to see if the case has resolved. Pesch's jury trial is scheduled for 6/26. If you read my previous coverage, a plea is no surprise.

Jury started deliberations in alleged molestor Sergio Reynoso Lozano's case around 2 p.m. on 6/14. They requested readback from portions of  testimony from Jane Doe 1 and 2. There were two notes yesterday. By the end of today, there were 11 notes in total.

Court appointed attorney tells client to stop criticizing him or take a hike

Today around 11:45, I was on the second floor of the courthouse and Tim Gray was talking to a man and a woman. He told them, stop picking apart what I am doing or get another attorney. Scared,  they complied.

Gray is a lousy attorney. For the 10 years, I have covered the local courts, he mostly sat around the law library or coffee shops pontificating. Gray was hardly in court. Too bad his skills are not as big as his ego. Gray gets paid by the taxpayers. Gray should be grateful he has cases at all.

Man with 5 prior convictions arrested for domestic abuse and child endangerment

 


Samuel Allan Jones was arrested by Eureka Police Department today for PC 273.5(a) corporal injury  to spouse or cohabitant PC273 a(a) child abuse or wilful child endangerment.

He has  convictions in 2021, 2018 and 2009 traffic cases and convictions in two DUI cases, one from 2006 and one from 2019.

Fat Cat Bakery is located on 7th Street in Eureka. I just heard from a source in the know that Ramone's is taking it over. I was at the Ramone's Harrison location and staff hadn't heard anything.

I have sent an inquiry to Ramone's and Fat Cat Bakery. Miles Ketchum from Fat Cat Bakery responded, "Thanks for contacting us. We can’t comment at this time but we appreciate the inquiry. Please refer to our Facebook page for any status updates."

I did two  posts on Jamael Brandon Lowery from 2019 and one from 2016.  53 cases come up for Lowery in the Humboldt Superior Court system from 2011 to his previous 2023 arrest.

This red car had been parked in the same spot in the Sacred Heart Church parking lot on 20th and Myrtle. Today was the third day and now more people were in the car with more belongings next to it. I decided to call HCSO dispatch. I gave the location, the description and was about to give the license number when dispatch said is it and read the exact number. HCSO deputies had already been called and were out there at 4:30 a.m. this morning. The car occupants did not leave. HCSO was great and followed up. There is only so much law enforcement can do. 

Self defense, manslaughter or homicide in Swains Flat incident between friends?

On June 9, 2023, at about 8:50 p.m., Humboldt County Sheriff’s deputies were dispatched to a residence on the 19100 block of Highway 36 near Swains Flat for the report of a homicide.

Joseph DeMarcus Coleman was arrested by Eureka Police Department yesterday for PC 466 possession of burglary tools, PC 21310 carrying a concealed dirk or dagger and PC 488 petty theft.

In 6 months, EPD to loose 5 officers with Greg Hill going over to the DA's office

Eureka Police Department has aready have lost 5 officers this year and it is only 6 months. Sgt. Eddie Wilson retired last December and moved to Redding. Officer Brian Wilson resigned, Comander Greg Hill is resigning this month and starting as an investigator at the Humboldt DA's officer and two other senior officers are applying to other agencies.
