He started to put his hand on my chest. I tried to move. He stopped. Then his hand was heading over to my chest again."

 

This is a continuation of the post I did earlier today on the start of the preliminary hearing with the testimony of Jane Doe 2 and 1. Jane Doe 2 said alleged molestor Sergio Reynoso-Lozano is "my sister's father." She called him  Chino and referred to him as such throughout her testimony.

"He was my father figure." Jane Doe 2 did not live with Lozano but stayed over on some nights. She lived with her grandma. The first time Jane Doe stayed over at Lozano's was when she was 9 years old. When she was younger, Jane Doe 1 spent time together alone because Lozano is Jane Doe 1's father. Lozano lived near Grocery Outlet, then on 14th Street and another house on Wabash which is across the street from her grandmother's house. Jane Doe 2 described the layout of the houses in detail. She answered clearly, without hesitation. 

At the Wabash house, the girls stayed overnight, mostly on weekends. There were a few nights Jane Doe 2 was there alone.

Lozano would cuddle with her in bed and touch her. At first, she was too young to understand. The first incident she described was at the Grocery Outlet house, Jane Doe 1 and John Doe, their brother were all in the same bed.  She was on the edge of the bed, facing the wall. "My back was facing him. He started cuddling me and his hand was on my chest. I was wearinga shirt and sweats. His hand was under my shirt, just laying below my chest. I didn't think it was anything inappropriate." Lozano's hand was there when she fell asleep and still there when she woke up.

The second incident Jane Doe 2 testified about was at the 14th Street house. She was 11 years old  "That time he also put a hand on his chest. I was in bed. My brother and sister were watching T.V. Chino was lying in bed with me. He started to put his hand on my chest. I tried to move. He stopped. Then his hand was heading over to my chest again." Lozano's hand was underneath her bra. She got up to go to the bathroom. Sat there for a few minutes. 

Jane Doe described another incident when she was at the Wabash house alone. Lozano's hand was on her stomach, "later his hand went up." She would move his hand and he would repeat what he was doing. She moved his hand "at least three times."Lozano's hand was "holding my breasts." Jane Doe 2 got up and went to the bathroom. When she came back, he was facing the other way.

Other incidents happened while Jane Doe 1 was there. "I slept in the middle. Jane Doe 1 on the other side. I could smell beer on her breath." Jane Doe 2 was sleeping with her back to Lozano. "I could smell beer on his breath." Lozano tried to cuddle. She moved closer to her sister; Lozano moved closer towards her and "stuck his hand under my shirt, his hand was on my breast." She "tried to wiggle away. Sometimes when she did that, he would stop; sometimes she would get up and "pretend to go to the bathroom."

During another incident at the Wabash house, she "felt his hand on my waist and his hands went into my pants. He put his hands on my bottom and "was rubbing her buttocks."

Sometimes Jane Doe 2 got up, went to the bathroom and when she returned, Lozano would be facing the other way. There were other times "she tied her pants tighter" so he could not "get his hands inside and she would move." 

"There are times I would wake up and he was touching me." Four times instead of just touching her breast, "he squuezed it."

Jane Doe 2 said she did not say "anything about the touching because she was afraid he would get mad."

"A couple of times on the street, he put his arm around me and stuck his hand under my shirt."

"Sometimes when he lay behind me, his private parts," she paused then clarified, "his penis was touching my back." This was skin to skin and happened a few times. The bed was shaking immediately after he touched her and then he would go to sleep. This happened 30 times. She thought he was masturbating. She was 13 when Lozano started living at the Wabash house.

"It was my sister's father, I did not want to interfere with their relationship," said Jane Doe 2 when asked by Ms.Timm why she did not say anything earlier.

During cross examination, Jane Doe 2 remained consistent with details. Sometimes she would ask Jane Doe 1 to sleep in the middle. Lozano always had beer on his breath when he touched her.

Jane Doe 1 looked down as she testified. She did not look at Lozano. Her responses were short, terse and you could sense her discomfort. It was hard to understand her sometimes from where I was sitting back in the courtroom due to her being soft spoken and her mumbling through her tears. Jane Doe said Lozano is "my dad."

She corroborated Jane Doe 2's testimony about where they slept in the bed and when they went over.

When Jane Doe 2 would ask her "to switch and sleep in the middle, he put his hand in my shirt." Lozano put his hand on her breast, "sometimes until he was asleep." 

When he touched her, it made her uncomfortable. "I was uncomfortable because he is my dad."

"Sometimes he put his hand on my butt when we went to the store," said Jane Doe 1. Both she and Jane Doe 2 mentioned Stop and Shop.on Wabash as the store. John Doe would sleep on the floor when they went over to Lozano's house. The girls would sleep in the bed with Lozano.

Lozano would drink, come to the bedroom, turn the lights out and touch Jane Doe 1 "inside and outside her clothes", touched her inner thigh and side of her buttocks. Lozano would rub Jane Doe 1's back and under her shirt.

Jane Doe 1 did not see Lozano touch Jane Doe 2 in bed but felt his hand "around Jane Doe 2's breast area." Jane Doe 1 also saw Lozano put "his hand down her shirt and touch her leg" while walking behind them to the store. "There was nothing I could have done.

When Jane Doe 1 was "8 or 9", she was touched by Jane Doe 3, one of her classmates at school and in the restroom. Jane Doe 3 followed Jane Doe 1 into a restroom stall and "touched her bottom." When asked where, Jane Doe 1 was upset and then blurted out, "where I pee."

Jane Doe 1 told Jane Doe 2 what happened at school. Jane Doe 2 started crying and said, "something was also happening to her."

Jane Doe 2 told her sister, "I can't tell you because they are important to you. It is a guy." 

"I was mad," said Jane Doe 1. "I didn't expect my dad would do that to my sister. 

Jane Doe 1 had counseling two days later. She told her counselor who told her mom. Then her grandma found out and "the police got involved."

"I did not tell anyone before because I was scared," said Jane Doe 1.

6/12: Jane Doe 1 resumed her testimony. She was asked if she had heard that Jane Doe 3 had been raped by her father and she responded, "yes and that she talked about it with Jane Doe 2. 

Lozano would also get upset if Jane Doe 1 would try and move from where she was sleeping in the middle. "He would do the touching before he went to sleep," said Jane Doe 1. Jane Doe 1 could feel Lozano's hand on Jane Doe 2's breast and she felt his hand on her back. "At that time I thought he was just wrapping his arm around her."

Deputy District Attorney Whitney Timm is the prosecutor for this case. Deputy Public Defender David Celli is Lozano's attorney.

Judge Kaleb Cockrum read a stipulation to the jurors before John Doe testified. "It is stipulated that the allegations between Jane Doe 1 and Jane Doe 3 were investigated by law enforcement and were confirmed to have taken place."

John Doe testified that it concerned him that Lozano would "sometimes come into the room, he would smack their butts." John Doe was referring to Lozano "butt smacking his sisters" and testified it "seemed wierd."
