It is refreshing to see local candidates for Judge so forthcoming

Finally! The cafe at the courthouse is up for sale and the right owner could make it thrive again

 


The cafe at the courthouse which has been closed for months is finally up for sale. The county has waived rent for the current owner since March 2020.

This sign was posted on the third floor where the cafe is located.

For any potential owner, the County had some work to complete so check on that as well do your research on the place. 

Are closing arguments necessary if defendant admitted guilt on the stand?


Closing arguments are scheduled to start any minute in the Delano Malang jury trial. The incident took place near the Arcata Plaza.

Motion by defense to reduce bail for convicted sex offender denied

 


On 2/28, there was a probable cause hearing in sex offender Ryan Landowski's parole revocation case.

Defense submitted on the report and did not present any evidence. Parole hearing is scheduled for March 28.

Just ran into local attorney Ken Bareilles at the Courthouse. I have known Ken,his wife and family members for several years.

Ken and his wife Linda live on a property with several acres and it isn't in a populated area.You have to drive or walk up to  the main house.

"In California, starting March 1, masks will no longer be required for unvaccinated individuals, but will be strongly recommended for all individuals in most indoor settings."


California Governor just issued a press release few minutes agoon the updated guidance regarding masks.

HCSO deputies locate attempted homicide suspect at a campsite

On Feb. 27, 2022, at about 3 p.m., Humboldt County Sheriff’s deputies served an arrest warrant on a man wanted by the Arcata Police Department in connection to an attempted homicide investigation.

Received this fake email and have reported it to Eureka Police Department

 



I just received this email. The subject line looked suspicious but I opened it. As suspected, it is a scam or phishing. Obviously, I know the correct email address belonging to EPD Crime Analyst Brittany Powell.

Askari Overall-Withers arrested for domestic violence, assault and criminal threats


Askari Overall-Withers was arrested by Eureka Police Department yesterday for PC 273.5 (a) corporal injury on spouse/cohabitant, PC 245 (a)(1) assault with a deadly weapon, criminal threats and PC 591.5 damaging/obstructing wireless communication device being used to notify law enforcement of a crime. Bail at booking is $50,000.

I remembered his name from a 2016 arrest


Quincy James McBride was arrested by Eureka Police Department yesterday for  possession of controlled substance, PC 1203.2(a) (2) probation violation and public intoxication. These were all misdemeanor charges and McBride was booked and released on O.R.

EPD is familiar with McBride. I covered an incident with McBride in 2016 when he was arrested for robbery.

$200,000 bail for 38 year old child abuse suspect after parent contacted law enforcement about 9 year old child

On 02-16-2022, a Mendocino County Sheriff's Deputy was dispatched to make contact with a concerned parent regarding sexual abuse of their (9) nine year-old child which reportedly occurred over the previous year in the 45000 block of Meadow Lane in Laytonville, California.

More litigation against the County from a State Bar inquiry

Besides the California Attorney General's final demand letter to Humboldt Auditor Controller Karen Paz Dominguez, other items of interest at the March 1 Board of Supervisors meeting is the potential appointment of John Fullerton to the Audit commitee and more litigation in closed session.

I wrote about his arrest and it is only fair to give him a chance to explain his side

Public health officials believe Shigella virus may have been spread through one or more Eureka laundromats after an infected person washed contaminated clothing at the facility

John Michael Nicklas arrested on domestic violence charge


John Michael Nicklas was arrested by HCSO for alleged violation of PC 273.5(a), corporal injury to spouse/cohabitant in an act of domestic violence last night. Bail at booking was $50,000.

Two day time estimate for Little Eagle Moon's preliminary and parole hearing

Today, dates were scheduled in two cases for Little Eagle Moon. His parole hearing and preliminary hearing for the arrest near Red Lion are both scheduled for April 18. Time estimate is two days.

Out of $50 million, City of Eureka gets $1.6 million to rehouse 50 individuals

I contacted Eureka City Manager Miles Slattery and Assistant City Manager Pam Powell and congratulated the City of Eureka. Mr. Slattery responded right away with how the funds will be used and how the money was obtained. The City of Eureka was one of 19 communities in California chosen by Governor Gavin Newsom.

Convicted sex offender David Dues' jury will resume deliberations after lunch. Closing arguments were given this morning. Final jury instructions were given by Judge Christopher Wilson starting 11:45 and at 11:56, HCSO Deputy Jen Taylor (Turner) who was the court bailiff escorted the jury into the deliberation room.

BDSM/Kink/Fetish expert testifies in convicted sex offender's jury trial

 


In convicted sex offender David Dues trial today, two witnesses testified about his fetish. Closing arguments are expected to start tomorrow.

Ben McLaughlin's formal campaign kickoff next week postponed

 


Deputy Public Defender Ben McLaughlin, the other candidate running for Judge Christopher Wilson was expected to make his formal announcement next Monday. That kickoff had to be postponed because of his trial schedule.

I will add more details about the event when the campaign sends out information.

Will Newsom's appointments bring any change to the Commission on Judicial Performance

Today, Governor Gavin Newsom announced 7 appointments to the Committee to Review the Operations and Structure of the Commission on Judicial Performance.

Today was Day 7 of the jury trial for Delano Malang. 

Plea offer of probation discussed in hit and run suspect Demmeri Carr's case

 


On February 22,  intervention was held in hit and run suspect Demmeri Carr's case. A plea offer was discussed.

The plea offer was conditioned on grant of probation unless the pre-sentence report contained information then that could change the Court's ruling on sentencing. If that happens, Carr would get her plea back. Preliminary hearing remains set for March 8.

On February 22, 2022, at about 7:35 p.m., Humboldt County Sheriff’s deputies were dispatched to the area of Harris Street and O'Neil Lane, in the county’s jurisdiction of Eureka, for the report of a disturbance between a man and a woman.

Austin Newman arrested for arson causing great bodily injury




Austin Charles Newman was arrested by UPD (HSU police) on an arrest warrant for PC 451 (d), arson of property of another. This is a felony charge and he was released on O.R.

Housing is a struggle in Humboldt whether you are on the street, low income and even harder if you are working but still face the challenge of affordable housing. There are options out there and the County does what it can with the programs, funds and specifications about who they can serve.

Deputy DA Steven Steward official campaign announcement this Wednesday


Deputy District Attorney Steven Steward will officially kick off his campaign for Judge Christopher Wilson's seat this Wednesday. Mr. Steward also has a Facebook page.


Judge Wilson is retiring. The other candidate for that position is Deputy Public Defender Ben McLaughlin.

Felon arrested by UPD last year returned to Humboldt from prison for two court cases

Felon Vincent Michael Olivo was booked into jail yesterday on warrants from two existing court cases. One from 2021 and one from 2020. He is on a no bond status. Olivo was transported to Humboldt from prison and is expected to be returned to custody in prison.

Charles Gay adds domestic battery to his constant arrests for probation violation and drugs

Charles Lloyd Gay was arrested by Eureka Police Department yesterday for PC 243(E)(1) domestic battery. Gay's bail was $25,000. He was released on O.R and he is out of custody.

Thanks to a vigilant community member and EPD, two dogs were saved and this frequent flyer was arrested for animal cruelty

 


Eureka Police Department arrested Loren Michael Lenhart yesterday for PC 597 (a), animal cruelty. Lenhart posted bail and is out of custody.

I just received this email from Jennifer. I am not printing her last name for privacy. She did not request that but it is for safety.

"Good morning! Hoping you can put this individual on blast on your blogspot. Yesterday a co-worker of mine came in to work in tears and shaking. She had just witnessed a heinous crime of an individual severely beating a dog and then stuffing it in the trunk of their car."

Jury trial for GOP vandalism suspect vacated


Intervention was held in GOP vandalism suspect Michael Valls's case on February 17.

Jury trial scheduled for 2/22 vacated. Attorneys stipulated to continue motion in limine hearing to 3/11/22. Diversion and trial setting is also scheduled on the same day.

Aaron Arlotta arraigned in fentanyl case and for probation violation

Aaron Arlotta was arrested on February 16 by the Fortuna Police Department on a bench warrant. I did a post on him in 2017 about his failure to appear, bench warrants and criminal history.

He was in court today for arraignment in a wheelchair. Arlotta looks quite different than he did in 2017. He no longer has long hair.
