No bail for mother arrrested for "willfully causing or permitting a child to suffer great bodily injury or death"

On 06-20-2018 at approximately 1:38 PM, Mendocino County Sheriff's Deputies were dispatched to a reported coroners case involving an small child at Howard Memorial Hospital in Willits, California.

Between 11 a.m. and 1:30, Cory Fisher's attorney discovered a conflict, preliminary delayed again, Marsden hearing scheduled next week

Cory Fisher's present attorney Joe Judge  told Judge Dale Reinholtsen he had a conflict today.  Nothing was said about this in the morning. So what happened between 11 a.m. and 1:30 today?

Mr. Judge has had this case since March 2018. The case was confirmed on 6/14 at intervention. No new discovery was given this morning. So what is this conflict of representing a prior witness that Mr. Judge and Conflict Counsel suddenly discovered during two and half hours today?

Mr. Judge's colleague Mr. David Lee was appointed to represent Fisher, last minute. Mr. Lee just got this case and could  not be prepared to represent Fisher today.

There have been several different attorneys on Fisher's case due to the David Marcus Public Defender fiasco. Conflict Counsel was appointed. The preliminary hearing has been delayed many times.

Fisher has requested a Marsden hearing and wants the court to appoint a private attorney to prevent these delays from happening. That hearing is scheduled for next Friday at 8:30 in Courtroom 3.

Law enforcement, the District Attorney's office, other witnesses just sat around since 9 a.m. this morning to be blindsided by a last minute announcement. This case requires prep to make a courtroom available.

After the Marsden issue is decided, a preliminary hearing will be reset.

Mr. Lee's made remarks the on the record but attorneys, the Judge and Fisher were in a closed courtroom for half hour.

"My client has concerns about representation he has received," said Mr. Lee. "Some of those concerns have nothing to do with our office."

"He is asking our office step aside and private counsel be appointed," said Mr. Lee. "My client is frustrated it is not going forward but he wants it done right."

"The people are ready to proceed," said Deputy District Attorney Stacey Eads. Realizing that the Court would grant the motion to continue and request for Marsden, Ms. Eads  requested the setting of the preliminary not be delayed beyond a week. "This matter is aging rapidly."

Ms. Eads starts jury selection for a lengthy jury trial next week. She has other jury trials, including the Marci Kitchen jury trial coming up and other cases. Rescheduling a preliminary which could take 4 hours or longer is not simply a matter of switching dates.

On January 5, at 1 p.m. EPD Detective Ron Harpham was contacted by Captain Patrick O'Neill who advised him a complaining witness had walked into the POP office. She said that "she had been repeatedly raped by her father and that these rapes had been videotaped."

Even before it was published on this blog, someone knew Jane Doe was Seng Yang's daughter

"I have been raped 6 fucking times. The person who did it was my dad."

Detailed testimony was given today that elaborated on the Ramey warrant that led to Seng Yang's arrest.

"The issue in this case will turn on the fact that Ms. Luna was not the minor nor the driver of the vehicle."

California attorney Allan Dollison weighs in on the Samantha Luna arrest.

"I watched these viral videos and read some of the coverage. This will be an interesting case. I think there was clear probable cause to stop the vehicle as the minor was placing part of their body through the sun roof of the car. Once a car is stopped police for officer safety have the right under most circumstances to order the driver out of the vehicle."

"The issue in this case will turn on the fact that Ms. Luna was not the minor nor the driver of the vehicle. The US Supreme Court addressed this in a very similar case called Brendlin v. California and ruled that a vehicle/driver seizure does not give law enforcement automatic detention authority over passengers. Law enforcement are allowed to ask passengers to identify themselves, by providing name and date of birth. Ms. Luna did provide that."

Suspect dead, victims of Walmart shooting in Washington survive

Police responded to a shooting inside the Walmart Supercenter in Tumwater, Washington. Armed citizen shot the suspect.

Two alleged victims, both survived. One victim was shot in the Walmart parking lot. The other at a local school. Suspect shot one victim while he was trying to carjack his vehicle.

Los Angeles County deputy sheriff arrested on suspicion of DUI after smashing truck into 5 parked vehicles

Nicholas Smith, a 24-year-old Los Angeles County deputy sheriff was arrested by CHP on suspicion of DUI after smashing his pickup truck into five parked vehicles in Palmdale early Sunday. No injuries.

About 100 people showed up and it was a very diverse crowd, including some local Republicans.
