Defense motion for a new trial in Godberg case states three jurors met privately outside the deliberations room, discussed the case and other and used extraneous information

Here is the entire defense response to the prosecution's opposition for a new trial.







The motion for new trial is lengthy. I am only posting some pages,










Ms. Humbert's  name was already mentioned at the last court hearing. As for the jury foreperson, his identity was well known in the courthouse to various people.
I knew his name prior to getting this document.

Nothing in these pages is something the jurors being interviewed don't know. This is information about their deliberations. The jurors were admonished during the trial for discussing the case by Judge Graham Cribbs.

At the last hearing, Judge Graham Cribbs ruled there was no prosecutorial misconduct in the Jon Goldberg jury trial.

On the motion for a new trial, he said" based on all presented to me and based on my own knowledge of the jury trial, the Court is going to make a finding that the defense has established to the satisfaction of the Court that there is a substantial probabity of jury misconduct that took place."


A status hearing is scheduled on July 30. Evidentiary hearing is scheduled for October 15.

I had requested the file in the Jon Goldberg case, right after the motion for new trial got filed. However, the file was only recently available to view.
