Over the objection of the District Attorney, a California Court decided to release a sexually violent predator into the community

The following statement was provided via
email to me by Deputy District Attorney Stacey Eads on the  Joshua Bryan Cooley case.



"In April 2016 the case was remanded by the Court of Appeals to Humboldt County Superior Court for further proceedings under Welfare & Institution section 6608.

Respondent/defendant, Mr. Cooley, petitioned the court seeking “conditional release” from Coalinga State Hospital where he’d been committed after a finding that he is a sexually violent predator within the meaning of Welfare & Institutions Code section 6600, et. seq.  Over the objection of the District Attorney, the court granted the 6608 petition in December 2016, ordering respondent/defendant be released under the supervision of the Liberty Healthcare Conditional Release Program.

Since that time Liberty Healthcare Conditional Release Program has been searching for a placement in Humboldt County.  Up until very recently no viable housing for respondent/defendant had been located.  This morning the court received additional information regarding the potential placement from Liberty Healthcare representatives and the court and parties were advised a notice of the possible placement would be forthcoming from the Department of State Hospitals.  So, additional information is anticipated.

The District Attorney will facilitate receipt of public comment regarding the proposed housing situation and will assist in compiling and channeling any such information to the court.

Additionally, the court scheduled July 26th as a noticed hearing regarding the potential placement.  Community members will be given an opportunity to address the court regarding the placement.  At this point we await further information regarding the potential placement.

  1. Hello, it appears the potential placement is 479 Howard Heights Rd in the Freshwater area of Eureka. Liberty Healthcare Corporation has apparently been paying rent to the owner of 479 Howard Heights Rd for the last 3 months in anticipation of placing the violent sexual predator on the property. No information whatsoever has been provided by either the property owner at 479 Howard Hts Rd, or the court, or Liberty Healthcare Corporation. There are kids and high-school-age foreign exchange students on the street. The neighborhood is highly concerned.

  2. Correction: placement is at 497 Howard Hts, not 479 Howard Hts. It's the landlord at 497 Howard Hts that is making an agreement with Liberty Healthcare Corporation to place a Violent Sexual Predator in the neighborhood.
