A defense motion to set aside two counts in the Chad Smith alleged molestation case was scheduled today.

Counts 1 and 2 are PC 288.7 (b) Oral copulation or penetration with a child who was 10 years of age or younger. Alleged victim Jane Doe #1 is Smith's stepdaughter.

Minnesota corrections officer attacked and killed by inmate serving homicide conviction


A Minnesota Correctional Facility in Stillwater was on lockdown after Corrections Officer Joseph Gomm was attacked and killed by an inmate this afternoon. The inmate is serving time for a homicide conviction.

Another twist in the Marci Kitchen jury trial, you will have to wait until Friday to find out more


Intervention for Marci Kitchen was scheduled for July 18. After 45 minutes of Judge Kaleb Cockrum meeting with attorneys privately; the courtroom was opened.

Judge Cockrum stated on record what an intervention hearing is; informal and private matters are discussed in closed courtroom including the possibility of  resolving the case. "We are still in middle of those conversations," said Judge Cockrum.

Attorneys in the Ewa Misztal case had another hearing scheduled for July 18 and are waiting on Dr. Chamberlain's report. Still no report, expected on July 20.

Deadliest Catch star Edgar Hansen pleaded guilty to sexually assaulting a teenage girl. According to his plea agreement, Hansen received a 364-day suspended jail sentence, is ordered to undergo a sexual deviancy evaluation, give a DNA sample to authorities and pay court fines and fees of $1,653.

The Redlands Police Department is forwarding indecent exposure charges to the District Attorney's office against a male who is alleged victim of a stabbing.

Cynthia Christine Molina was arrested on suspicion of assault with a deadly weapon. After questioning her, the Redland Police Department learned the male victim had exposed himself to Molina before the attack.

Samantha Alonso Luna, was arrested on June  16 following an altercation with a UPD officer. She was booked on suspicion of resisting arrest, battery on a peace officer, public intoxication, and providing false identification to a police officer."

I checked today with the D.A. s office. No charges have been filed yet, the case is in "pending" status.

Motion to consolidate both of Michael Grant's cases and motion to amend information granted



Attempted murder suspect Michael Grant has two cases. Today, there was trial confirmation scheduled for one case, a motion to amend information as well as a motion to consolidate both cases. Both motions by the People were granted.

Judge Wilson said that while the law allows the People to amend information up to trial, this was a 2017 case and the people were amending the information "on eve of the trial."

Outpatient patient denied for Kimberly Felder , she is going to the state hospital


Receipt of CONREP report for Kimberly Felder was scheduled for July 10; it was  continued to the 17th since no report was received. Today, after some comments from Public Defender Marek Reavis, Felder was ordered to be committed to state hospital.

Judge Wilson told Mr. Reavis, outpatient treatment was not appropriate. A hearing is set on July 31 to confirm status of transport.

 Felder was found not guilty by reason of insanity.  She pleaded no contest to attempted murder and the special allegation of inflicting great bodily injury. The victim is her daughter.

Second request to continue trial setting for Mark Dare's alleged molestation jury trial


Trial setting for Mark Dare's preliminary hearing was scheduled for July 16. It was continued to August 6 at defense's request. Dare is charged with molesting his own stedaughters.

Lawrence Killoran to serve as interim commissioner until he is sworn in as Judge


Lawrence M. Killoran was elected Superior Court Judge on June 5, 2018.  He will replace the vacancy created when Judge Dale A. Reinholtsen retires at the end of this year.  In the interim Mr. Killoran will be  appointed  Commissioner   until  he  is  sworn in  as  judge  serving  in  a criminal  assignment  on January 2, 2019.

Defense wants a continuance for murder suspect Richard Dean's preliminary hearing


Murder suspect Richard Dean had intervention scheduled for July 10; it was vacated and set for July 12. On that date, intervention was continued by stipulation.

Intervention and a motion for continuance is scheduled on July 23. Preliminary hearing is currently set for July 24.

An autopsy revealed that the baby’s blood contained methadone, amphetamine and methamphetamine, which prosecutors allege was passed to the baby through breast milk.

DA motion to advance Charles Cole's jury trial granted




Charles Cole had disposition and reset scheduled for July 16 for one of his two 2016 cases. The other case was on for trial confirmation and motion to advance jury trial.  Deputy. DA's motion to advance jury trial was granted.


Cole was transferred back in June from the state hospital and criminal proceedings have been reinstated.

Mexican national impersonated U.S. citizen and stole $360,908.85 from California government agencies


Andres Avelino Anduaga, a Mexican national admitted to impersonating an American citizen for more than 30 years. He was sentenced in San Diego to 37 months in federal prison for stealing more than $350,000 in government benefits from government agencies.

He had also been deported twice, in 1994 and 2000.

Maximum sentence for Jessie Matthew Herrera is 7 years and 4 months in prison



Today a Humboldt County jury found Jessie Matthew Herrera guilty of possession of a firearm by a felon and unlawful possession of ammunition by a felon.

Frequent offender Brett Neil Hansen gets 14 years, 4 months in state prison


According to a press release from the District Attorney's office, " earlier today, 30-year-old Brett Neil Hansen of Arcata pled guilty to carjacking, grand theft, and first-degree residential burglary. The defendant also admitted to using a firearm during the carjacking."

Caleb Dain Silver sentenced 33 years, 8 months to life for the murder of Dennis Boardman



The man convicted of the Christmas 2015 murder of Denis Lee Boardman in Fort Bragg received a life sentence this afternoon in the Mendocino County Superior Court. 

Kody Marcelli's buddy testified that Marcelli told Harner's wife, "Shut up you dumb bitch"


The defense's last witness was Kody Marcelli's buddy since kindergarten, Jonathan Christian. He lives on Walnut street (again will not print the exact address) about half a mile from where the altercation occurred. He said Marcelli had an apartment but has been living with his mother "for about a year."

Usually, the deputies testify for the prosecution. In this Kody Marcelli preliminary hearing, HCSO Deputies Eric Morris and Ryan Hill testified for the defense.

"It is very hard to recall what we went through."


The second witness to testify at Kody Marcelli's preliminary hearing for alleged assault was the alleged victim's wife, Diane Harner.

"Mr. Marcelli punched Gary multiple times."

"He said he was going to hit me."

For someone on probation and facing assault charges, Kody Marcelli chooses to act out in and outside the courtroom?



Kody Marcelli is on probation for a plea he entered in a DUI case. Check out the timing of when the DUI case was filed, when the assault case was filed and the charges in each case. The DUI case is a 2017 case, the alleged assault happened in September 2017.

As a part of his plea deal, Kody Marcelli had his firearms returned to him because he took a basic gun safety course. In that DUI case, he was charged in the complaint with being drunk and carrying a loaded firearm in public.

Attempted murder suspect who allegedly used a chainsaw on the lam




Today, at approximately 3:00pm, officers responded to the 7700 block of Milton Ave. in the City of Whittier regarding an attempted murder stemming from a domestic violence incident. When officers arrived they found a female adult suffering from traumatic physical injuries, believed to have been inflicted by a chainsaw.  The victim was transported to a local trauma center and her current condition is unknown.

No prosecution expected in Big Lagoon collision, at this time



On July 11, 2018, at approximately 1240 hours, officers responded to a report of a collision on US 101 near Big Lagoon.

The woman who yelled "Go Back to Mexico" was arrested for assault of a 92 year old, bail set at$200,000

30-year-old Laquisha Jones of Los Angeles, was arrested for assault with a deadly weapon. She is being held on $200,000 bail.

Her arrest is in connection to the brutal beating of 92 year old Rodolfo Rodriguez.
