Brief motion to continue Marci Kitchen trial granted, new trial date September 4

Intervention was continued to July 20 for Marci Kitchen. The jury trial for August 20 was vacated today. New jury trial date is September 4. Trial confirmation remains scheduled for August 9.

After calling the case on the record, Judge Kaleb Cockrum said, "we discussed scheduling, timelines and possible resolutions." Since these possible resolutions  were doscussed during intervention, Judge Cockrum clarified they were off-record.

A motion to continue was filed by defense.

"We are conducting ongoing investigations," said Conflict Counsel Supervising Attorney Meagan O' Connell. "It is a brief continuance. My expert will be done by August 23. I will file my motion the following day."

"The People are opposed to another continuance," said Deputy District Attorney Stacey Eads. "The case was set in May,; defense said they would be ready to proceed. We found ourselves with yet another date; August 20, again promises were made" (about being ready for trial). "It's been over two years since two young girls were tragically killed."

"When I make a decision, I have to balance the rights of Ms. Kitchen,the families and the victims," said Judge Cockrum.

Judge Cockrum said he had to make a neutral decision to ensure a fair trial.

"I am disappointed that we have to make another continuance," said Judge Cockrum. He said he found good cause to grant this continuance."We discussed a realistic timeline."

Judge Cockrum ordered the other defense  motion to be filed August 3. A supplemental motion could be filed on August 24, he said.
