A motion should be forthcoming from Conflict Counsel tomorrow ( if it has been received or filed, it has not been entered in the system) but an order shortening time has been filed on 7/19.
In my post from July 18, I mentioned that Judge Kaleb Cockrum told attorneys they needed to file any motions before the (continued) intervention on 7/20.
So what will this motion be? A motion to continue? A motion for change of venue?
I have heard from people who were contacted by a research company this week asking them questions about the Kitchen case, what they had heard on social media , about media coverage, pre trial publicity and their feelings about this case, their feelings about Kitchen.
The person calling did not know whether he was calling a landline or cell phone.

So one of the requirements for a change of venue is actual data. It could be the phone calls were about. A jury consultant sometimes collects data. I doubt a Jury Consultant is being used. Venue changes do happen but they are exceedingly rare. The police officers who were accused of excessive force against Rodney King and Scott Peterson who was convicted of killing his wife. It is technically not too late, but because the Defense waited so long (to be fair, current public counsel has only had the case a short while, some of the negative publicity has definitely recided. It would be astonishingly expensive to transfer case now. Would likely lead to a continuance. If they make this motion, it will likely lose. I also think that you can find 12 fair and impartial jurors. I had a case that had a lot of coverage in the now defunct Eureka Reporter. I remember that the jury was extensively voir dired. Most said they never read the paper and when they did it was to read about High School sports.
ReplyDeleteMaybe back in the day before social media Re the now defunct...insert every newspaper and the failing Times Standard. If this case we're 15 years ago I wouldn't have had heard of Marcy Kitchen, now thanks to social media my brother in Colorado even has a good understanding of the case.
