DA did not file charges by today to arraign Sarah Michelle Kitchen for her new case so she was ordered to be released today


Sarah Michelle Kitchen's 2016 arraignment has been moved up from 8/24 to today at 1:28 p.m.. She was booked on the arrest warrant on that case and released on 7/20. She was arrested again a couple hours later on 7/20 for PC422, criminal threats and PC 166 (a) (4), violation of a court order. Bail $50,000.

As of 1: 20, there had been no charges filed  for the second arrest. In court, this came up and as of 2:30 p.m. no charges had been filed. She was not on for late arraignment today.

Conflict Counsel Supervising Attorney Meagan O'Connell made this point to Judge Graham A. Cribbs asking that Kitchen be released from custody. Kitchen was not being held on charges from the 2016 case. She had been released on O.R. on that case.

Ms. O'Connell asked if the people were filing charges in the new case. If not, she asked Kitchen be released and a  hearing be scheduled on July 27 to address whether Kitchen had been detained lawfully. OR/Bail could be addressed on July 27, if peoole had filed charges by that date.

 Judge Cribbs even gave Deputy District Attorney Trent Timm and Deputy District Attorney Roger Rees time to go check on the status of the new case before granting Ms. O'Connell's request.

The DA's office stated charges are still pending. Since Kitchen was not arraigned within the time required (for inmates in custody), Judge Cribbs ordered her release. She is to return to court on July 27 for a pre trial hearing.

July 27 update: Dates set previously were vacated. Still no charges filed for recent case. Her 2016 case was moved to early resolution court; the next court hearing is September 23. Since that is a Sunday, am checking on the date. The date was corrected 9/13 in the system.

A new Deputy District Attorney being trained today, Jessica Acosta (need to check spelling of last name) got a preview of Humboldt Superior court, just with this case alone.
