If funding requests are approved, there maybe a motion to continue Chad Smith's jury trial



Trial confirmation for Chad Smith was scheduled today. A defense motion to set aside two counts is scheduled to be heard tomorrow on July 19.

Counts 1 and 2 are PC 288.7 (b) Oral copulation or penetration with a child who was 10 years of age or younger. Alleged victim Jane Doe #1 is Smith's stepdaughter.

As of this morning, the District Attorney had not filed an opposition to the defense motion to set aside Counts 1 and 2. Deputy District Attorney Stacey Eads told Judge Dale Reinholtsen that "the People are ready to confirm for trial" and that she just got back yesterday to the office and had prepared an opposition and requested it be filed in court.

Ms. Andrea Kaluna Sullivan was court appointed to represent Smith. Ms. Eads said Ms. Sullivan had shared some information with her today.

Ms. Sullivan told Judge Reinholtsen she had submitted two funding requests, one 10 days ago and one 2 days ago. Judge Reinholtsen had not received those requests. Ms. Sullivan said she would be submitting additional funding requests for experts.

"I don't believe we will be ready by August 6, if funding is approved," Ms. Sullivan. "I maybe filing a 1050 motion, once I received the funding orders back."

Ms. Eads said of the six week trial estimate, it would take at least three days to go over motions in limine.

Just like last time, the jury pool will fill out two questionnaires.

As I noted previously, from the first time Ms. Sullivan took over this case, Chad Smith's demeanor has been different. He has been better behaved in court.

Smith's wife Amy attended the court hearing with a Victim Witness Representative.
