Convicted felon Robert Cullen had arraignment scheduled yesterday for his most recent arrest. It was continued to this afternoon and again to Monday.

Jail contraband case keeps getting continued because all defendants need court appointed private attorneys

 


Setting of preliminary hearing for former correctional deputy Ricardo Aguirre Perez scheduled today was continued to May 4 because none of the defendants can be represented by Public Defenders and they need to find private attorneys for all of them. Just arraignment is leading to continuances.

Demmeri Carr charged with felony hit and run in West Hawthorne collision


Due to various factors, Demmeri Carr has not been booked as of 5/3/21. I did follow up with EPD and when a booking photo is available, it will be added.

Hit and run suspect has no license, no insurance and expired registration

On April 29, 2021, at about 4:00 p.m., officers of the Eureka Police Department responded to the intersection of Buhne and “H” Streets for the report of a vehicle vs pedestrian collision. While responding to the collision, it was reported that the driver and vehicle involved in the collision had left the scene.

Seng Yang three time loser can rot in prison where he belongs

 


I previously reported that convicted molestor Seng Yang, who raped his own daughter and filmed the rapes to sell as porn, lost his appeal. His petition for review was denied by the California Supreme Court.  Pages from the opinion are in the previous post.

Remember former Humboldt County Correctional Deputy and convicted molestor Cory Fisher? Today, on a hunch, I checked to see if he had filed an appeal. He did. The last scheduled action was a request for oral argument.

Jane Doe #2 and Jane Doe #1 addressed the court today after Judge Christopher Wilson and attorney remarks.

Dare's former stepdaughters briefly but in powerful statements expressedthe constant continuances that have been par for the course in this case as well sentencing being postponed. Deputy District Attorney Whitney Timm also addressed the Court on her motions.

What I mentioned in the previous post is exactly what happened. Career criminal Kevin Haberman's attempt to get released from custody and reduce bail backfired due to his record and recent arrest. Now, he has a no bail hold which issued by Judge Christopher Wilson.

Haberman's third court appointed attorney, Mr. Zachary Curtis' recitation of his criminal history helped the prosecution, supported Probation's recommendation and Judge Wilson's ruling.

Monika Wissel, Kyle Zoellner's mother and her co-defendant Tom Duncan, had a preliminary hearing today in 2020. I have not covered Wissel since 2019. In previous coverage linked below, there is a post from 2016; Wissel was arrested with a Tommy Duncan. For her latest case, her attorney is Deputy Conflict Counsel Owen Tipps. Three day time estimate for murder suspect Daniella Moore's preliminary hearing

 



Preliminary hearing for murder suspect Daniella Moore was scheduled for April 29. It was rescheduled for June 21. This will be a three day time estimate.

Finally after several hearings, issue of confidential witness John Doe's phone records was settled today in murder suspect Ulisses Rodriguez's case. Dates were set on a time waived basis.

Convicted felon Robert Cullen was a no show at trial confirmation this morning. So was his attorney, Mr. Michael Acosta. He was arrested and booked into custody later today and more charges with a new arrest.

Sacramento County District Attorney Anne Marie Schubert has announced she will be a candidate for Attorney General of California in 2022. Schubert made her announcement Monday morning while flanked by numerous crime victims, including victims of the infamous Golden State Killer.

Itria Ventures LLC, is a company in Wilmington, Delaware. Description of the company on google is "financial consultant" and "a private lender for real estate." Itria sued Joseph and Jean Mazzotti and Mazzotti, LLC for breach of contract and warranty.

Humboldt criminal Cory Orsenico " intentionally collided" with another car "killing himself and two other people"



Cory Orsenico, who was arrested on March 10 after he fled from the Orick motel, died today.

In response to a recent outbreak in Eureka The Pentecostal Church, Public Health offered tests to members who may have been exposed



Twenty new cases of COVID-19 were reported in Humboldt County today, bringing the total number of county residents who have tested positive for the virus to 3,717.

Thirty-eight new cases of COVID-19 were reported in Humboldt County today, bringing the total number of county residents who have tested positive for the virus to 3,697. With one day left to report, 110 cases have been reported this week.

I already reported on Kyle Muhaw's extradition warrant from Georgia. Judge Lawrence mentioned that in court today. Supervised release was denied. Based on comments from the People and his own remark about clear and convincing evidence that Muhaw's release would result in great bodily injury to others, Judge Lawrence Killoran maintained his previous ruling about no bail for Muhaw.

Former HSU student Darrius Upshaw's alleged victims were also HSU students

 


Defense filed a motion to reduce bail or have the Court consider alternatives to release alleged rapist Darrius D. Upshaw  from custody. Upshaw's bail was set at $225,000 per schedule. The end result was a no bail hold.  Defense motion for reconsideration was denied.

In Humboldt courts, if one defense attorney does something, then a trend follows. The latest is Humphrey's motions for repeat offenders or inmates charged with serious crimes.  Today, all three cases I am covering involving bail and all the defendants meet the above criteria. Different Judges will hear each case.

Why do they get to ignore and hang up on press?

 

"A year ago, attorneys could access holding cells. It was a mistake."

 


More motions in limine were heard in the Jason Smith jury trial today. I was not planning on covering this trial; let alone motions in limine in detail but this case and the defense motions have highlighted some concerns about local courts, jail and the criminal justice system which in a small rural county like Humboldt have dire consequences.
