Brian Daniels' resumed with the testimony of the second eyewitness, Christina Rosenfeld this morning.
Ms. Rosenfeld corroborated the testimony of her friend, Ms. Joanna Cloutier providing more details.
Ms. Rosenfeld works locally for the California Department of Justice in the bureau for forensic service. She has experience with firearms at her job and also growing up since her dad was a hunter and taught her about gun safety and using firearms.
Before she testified, after she testified and during her testimony, Deputy District Attorney Luke Bernthal brought up her nervousness and her voice shaking. Ms. Rosenfeld said she is uncomfortable talking to strangers but more so because she did not want to "relive it." She was a "wreck and could not sleep for a month after the shooting and "it is still hard to talk about what happened."
Ms. Rosenfeld and Ms. Cloutier were having dinner at 511 on December 26, 2018. Ms. Cloutier's car was near the intersection where the Fish and Game Building and Smugs is on Second street in Eureka. Ms. Rosenfeld's car was about two blocks away. Her dog was in the car. After dinner, they were walking with the dog near 2nd and H.
"This truck was driving up on 2nd Street going towards the Carson mansion," said Ms. Rosenfeld. "The driver had the window down and said, ' I am going to fucking shoot you'. He fired five shots very rapidly."
Ms. Rosenfeld identified Daniels as the driver of the truck. She said that she counted the shots becaude "if something goes down, I need to provide a statement."
Ms. Rosenfeld had a "small semi -auto in her purse. The thought briefly occurred to me," about taking that gun out but she didn't think it was responsible. "The threat was leaving" and the vehicle was moving. In her work, Ms. Rosenfeld has been tp crime scenes and she has seen the dangers of bullet penetration.
She tried to get a license plate, make or model of the truck. "It was a white truck with black after market bumpers." Ms. Rosenfeld called 911.
At the time of the shooting and as the truck was leaving, Ms. Rosenfeld was thinking, " Is this credible? In downtown Eureka, people shout random things; they don't drive nice trucks. He was looking behind him. I wasn't sure who he was talking to. Am I going to be in crossfire?" She was worried "he would come back."
Ms. Rosenfeld is the wife of former Humboldt Deputy DA Josh Rosenfeld who now works at the Mendocino Deputy District Attorney's office.
It was determined later in the investigation that Daniels had an imitation gun. Ms. Rosenfeld spoke with EPD Officer Heinrich Soltow a few times She had notes she wrote down the day after the incident.
Officer Soltow testified this afternoon. The jury was shown evidence which included the starter pistol found in the truck. Body cam footage was played for the jury. In addition to the pistol, primers and packaging for the pistol was located in the "light grey lifted truck with after market parts." Officer Soltow pulled over the driver and passenger of the truck near Samoa bridge.
