Itria Ventures LLC, is a company in Wilmington, Delaware. Description of the company on google is "financial consultant" and "a private lender for real estate." Itria sued Joseph and Jean Mazzotti and Mazzotti, LLC for breach of contract and warranty.
Judge Kelly Neel asked Itria's Ms. Veronica Nauts about status of service on non-defaulted parties.
Ms. Nauts said that attempts to personally serve Joseph Mazzotti and agent were unsuccessful. Itria hired a private investigator and found out Mazzotti's filed for bankruptcy on December 30, 2020. Due to the bankruptcy, there was an automatic stay. That bankruptcy action was lifted and Itria is seeking additional time for service.
On January 11, 2021, there was a default and Itria only learned of the bankruptcy on January 27,2021.
Itria asked for dismissal against Jean and Joseph Mazzotti "in personal capacity"; the party still being sued is Mazzotti LLC. Itria will serve Mazzotti LLC via the Secretary of State.
8/2/21: Dismissal hearing scheduled.
