Probation & DEJ for statutory rape and lewd acts with a minor under 14

 


Defense made an offer in alleged molestor Patrick Marshall's case which was accepted by the People today at trial assignment. The jury trial scheduled for Monday was vacated.

Marshall will plead guilty to the felony charge in Count 4,  PC 261.5 (d), statutory rape. There is no opposition to probation. He will also enter a guilty plea for the misdemeanor charge in Count 1, PC 288 (c) (1), lewd acts with a minor under 14 with a 18 month deferred entry of judgement. The remaining counts will be dismissed.

Deputy District Attorney Carolyn Schaffer is the prosecutor for the case. DA Maggie Fleming appeared on the case for trial assignment. Deputy Deputy Public Defender Casey Russo was present in court for his office.

Marshall was present via Zoom but Mr. Russo spoke with him and appeared 977 for him when the case was called. Entry of plea is scheduled for May 6. Time was waived today.
