Defense motions in Jason Smith jury trial scheduled for argument

 


Humboldt Superior Court was waiting to hear back from the California Judicial Council about three defense motions filed in the Jason Smith case.

There was nothing mentioned by Judge Timothy Canning about the California Judicial Council today.

Nothing happened today. There was some discussion back and forth about dates; specifically April 12 and April 15. As of today, the motions will be heard on April 12.

Deputy Conflict Counsel April Van Dyke  filed motions to dismiss the jury, recuse the judge for prejudice and recuse the District Attorney's office in the Smith trial.  

The conduct alleged occurred during the jury trial process.

Deputy District Attorney Trent Timm told Judge Kaleb Cockrum that the California Attorney General has filed the motion to oppose the recusal of the Humboldt County DA.

The Smith trial is currently on hiatus.
