Kailan Meserve files petition to review to exhaust state remedies

 


I reported back in January 2021, convicted rapist Kailan Meserve's appeal was denied. Here is the latest on that appeal.  Meserve filed a petition to review to exhaust state remedies.

After decision by the Court of Appeal in a criminal case, a defendant may file an abbreviated petition for review in the Supreme Court for the sole purpose of exhausting state remedies before presenting a claim for federal habeas corpus relief.

Remittitur is a court order that transfers the jurisdiction of the case back to the trial court.

Manuel Olaso was a no show for the writ of habeas corpus filed in Humboldt Superior Court.
