Meserve "serious medical condition" and attorney's medical procedure result in continuance

 


Convicted rapist Kailan Meserve had a pre trial hearing in his writ of habeas corpus case on January 19. An evidentiary hearing is scheduled on February 1.  Both hearings were continued and reset.

Meserve's attorney is Mr. Manolo Olaso. If Humboldt Superior Court research attorney Bryan Daley was present via Zoom, he did not speak today and his presence was not mentioned during the livestream.  Deputy District Attorney Carolyn Schaffer is the prosecutor for the case.

Mr. Olaso told Judge Christopher Wilson that Meserve has been temporarily transferred to another facility where he was treated and "is recovering from a serious medical condition." Meserve will be transferred back next month.

Mr. Olaso added, "Lead counsel Johnny Griffin is undergoing a medical procedure " next month and is expected to return next month.

Defense requested a continuance and wanted dates in late March.

Ms. Schaffer said, "People will submit. I am triple booked for February 1" and she had informed defense of her schedule.

Pre trial is on February 8; evidentiary hearing is on March 29. Judge Wilson said March is booked, this is a five day estimate and dates were granted with a caveat.
