Newsom wins on indoor ban but could lose with church attendance cap

 


On January 22, The 9th U.S. Circuit Court of Appeals on Friday ruled against South Bay United Pentecostal Church of Chula Vista.

The judges agreed the  church is suffering “irreparable harm,”  but stated that California’s COVID 19 restrictions on indoor services to did not limit First Amendment rights. 

This indoor ban can be revisited if a California county moves into a less-restrictive COVID-19 tier.

The judges said the church could succeed in its claim that the state’s 100- and 200-person attendance caps were unconstitutional and sent that issue back to lower courts for consideration.
