"Mr. Acosta you with us this morning?"

Convicted human trafficker David Anderson's jury trial was scheduled to start on January 19. It is on calendar again on January 25. 

The case has been assigned to Judge Christopher Wilson and he is meeting with attorneys for an intervention hearing this afternoon.

At trial assignment today, the initial call was going on and Judge Kaleb Cockrum called out to Anderson's attorney, Mr. Michael Acosta, three times and  texted him via Zoom a few minutes ago and Acosta had still not responded.

"Mr. Acosta you with us this morning?" was the first time. This was around 9:35 a.m.

"Mr. Acosta, have you joined us yet this morning?This was around 9:48 a.m.

"Mr. Acosta, I have asked you to unmute; trying to reach you this morning." This was at 9:51 a.m.

After this Judge Cockrum had to get up and go over to where the tech set up is in the Courtroom and text Acosta via the Zoom feature. Acosta did not respond to that text.

Right after my post was published, around 10:09 a.m, Acosta was on Zoom and he finally responded to Judge Cockrum's 4th question, "Mr. Acosta, can you hear me?" and confirmed the jury trial, "It's a go."

This isn't the first time Acosta has done this and it wastes time and creates a backlog and delay. 

Deputy District Attorney Stacey Eads is the prosecutor for the case. 

There were  remarks made by Judge Cockrum about purple tier, jurors not showing up and the impact on courts.

I will publish those remarks in a separate post. Judge Wilson repeated the part about only one trial at a time per Public Health.

There is already one trial going on right now which is supposed to end on February. Once that trial concludes, Abarr or Anderson will proceed. One, both or neither case may resolve by the 25th so more information will be available on that date.

Anderson time estimate is four weeks.
