The latest defense attorney trend in Humboldt is Humphrey's motions

 


In Humboldt courts, if one defense attorney does something, then a trend follows. The latest is Humphrey's motions for repeat offenders or inmates charged with serious crimes.  Today, all three cases I am covering involving bail and all the defendants meet the above criteria. Different Judges will hear each case.

Sometimes it isn't the attorneys but the inmates who hear that one person did something and then the same strategy and motions are filed by several attorneys without considering other factors about the case or defendant.

I just happened to cover frequent offender Kevin Haberman's hearing today. There is another hearing on April 26. Haberman is on his third court appointed attorney, currently Mr. Zach Curtis. Ms. Christina Allbright, was his first attorney; then Mr. Joe Judge was appointed.

Judge Kaleb Cockrum ordered a supervised release report. He told Mr. Curtis that he will hear arguments regarding a Humphrey determination, "even though Mr. Haberman maybe otherwise ineligible."

Deputy District Attorney Jane Mackie is the prosecutor. She told Judge Cockrum source of bail was not addressed. There was some mention of first and second releases and prior counsel.

Haberman's current bail is $500,000.

4/26/21: Case was continued to April 27 because Mr. Curtis provided a financial declaration for Haberman. It was continued again to April 29 because Mr. Curtis had not received the supervised release report.
