Hugo Aguirre fist bumps another inmate in jail court room

 


The hearing for Hugo Parral Aguirre started with him fist bumping another inmate in jail court room. Then he tried to pose " all bad ass" for the Zoom camera. Does he think his bros are watching the livestream?

Trial confirmation for ParralAguirre was scheduled on April 21. Jury trial for May 3 was vacated.

Conflict Counsel Supervising Attorney Meagan O'Connell is Aguirre's attorney. Deputy District Attorney Stacey Eads is the prosecutor for this case. 

Aguirre is charged with attempted murder of HCSO Deputy Rosalie Freixas; attempted murder of Carol Fuentes;  false imprisonment of Courtney Schlapicohl and assault with a firearm on HCSO Sgt. Greg Musson.

There was a motion to continue by defense that was granted for good cause. There is another defense motion set for Monday by defense which reveals the impact of  COVID 19, jail policies and staffing issues. 

Ms. O'Connell made a motion to continue due to ongoing investigation. She has not been able to meet with Aguirre accompanied by an interpreter. 

Ms. O'Connell is filing a motion with notice to County Counsel claiming that the jail is not allowing an in person meeting with Aguirre. Previously, the jail allowed meetings in a larger room. This was during the purple, red and orange tier.

Now, with COVID 19 and social distancing requirements, the confidential meeting rooms do not allow for an interpreter to be present. Ms. O' Connell needs to go over discovery. She mentioned Aguirre's mental health status and language barriers as a request for the meeting. Every Tuesday, her investigator met with Aguirre. He has not been allowed to do so the last few times. Due to staffing issues; jail has cancelled appointments.

Judge Wilson said, "this is something we can take up next Monday."

"I am appreciative of Ms. O'Connell letting me know in advance of the motions," said Ms. Eads. She said she recognizes there is good cause for the motion to continue because this is "due to circumstances outside Ms. O'Connell's control." The case is four years old and due to the age, Ms. Eads objected on record.

Trial confirmation is on August 9.; jury trial Sept 20.

4/26: No motion regarding jail was filed as of today and the case was not on calendar.

8/9: Trial confirmation continued to September 1. Subpoenaed records provided to defense.

9/1: Trial confirmation continued to 9/8.

9/8:  Motion to continue granted over People's objection. Trial setting 9/29.

11/17:  Pre trial held. The next hearing is 11/30/21 motion for subpoenaed documents and in camera review/receipt of notice to consumer. Trial confirmation is on 4/5/22; jury trial is on 4/18/22.



11/30:  On for motion for subpoenaed documents/in camera review/return of notice to consumer.Judge Timothy Canning had not completed in camera review so motion for release of subpoenaed documents was continued to 12/1.

 12/1:  Motion granted.
