The day to day rescheduling of the Jason Smith case is achieving bupkis


The Jason Smith trial is on hiatus. The day to day rescheduling of the case is achieving bupkis and wasting time. Yet, another example of the mismanagement by Humboldt Superior Court.

"We can't move forward today," said Judge Kaleb Cockrum.

The sensible thing would have been to wait until the California Judicial Council had taken action on the motion to recuse the Judge  They finally did. They sent the 170.1 to Del Norte Superior Court and there is no idea when that ruling will be issued. Until there is a ruling, the other motions cannot be heard.

Deputy Conflict Counsel April Van Dyke has filed motions to dismiss the jury, recuse the judge for prejudice, recuse the District Attorney's office and a Humphrey's motion.

Just today, it was announced that there was a 170.6 filed by Ms. Van Dyke in one of Smith's cases.

The California Attorney General filed the motion to oppose the recusal of the Humboldt County DA.  Ms. Joyce Blair from the California Attorney General's office has been there everyday. No idea if anything will happen. The hearing was continued until tomorrow. A date Ms. Van Dyke requested twice and was previously denied. 

Today, Conflict Counsel Supervising Attorney Meagan O'Connell appeared for Ms. Van Dyke who was unavailable.

Ms. Blair cannot be there tomorrow. Another attorney will appear. She asked if Friday was available, Judge Cockrum isn't. I assume because of trial assignment. He has been calling that calendar for several weeks. 

Deputy District Attorney Trent Timm is the prosecutor for this case. All this time being wasted and creating more backlog.

We have a third jury trial room just sitting there that hasn't been used since it was created.

This mismanagement occurs because the two organizations overseeing the Courts, the California Judicial Council and the California Judicial Commission are incompetent and maintain the status quo just like the state of  California. Why isn't there independent oversight?

Assigning any case from Humboldt Superior Court to Del Norte Superior Court or Mendocino Superior Court is meaningless. It's small, interconnected communities with people knowing each other.

All under the leadership of useless Gavin Newsom. There is an article in CALMatters about millions in unpaid fines which includes politicians, lobbyists, campaign donors and includes California judges. The Secretary of State asks what can they legitimately do? How about holding all the above to the same rules and regulations like the rest of us?

Public Health, Newsom and the California Judicial Council created this mess with closing the state and remote court. They aren't paying the price for their bad decisions. They collected their taxpayer funded paychecks during the pandemic while devastating people's lives, reputations, livelihoods and not giving a damn about freedom or basic rights.
