Finally after several hearings, issue of confidential witness John Doe's phone records was settled today in murder suspect Ulisses Rodriguez's case. Dates were set on a time waived basis.
"After some additional time to review and speak with the officers, I don't see an Evidence Code 1040 concern at this time," Deputy District Attorney Luke Bernthal told Judge Lawrence Killoran.
"My intention is to turn the records over to Ms. Sullivan today," said Mr. Bernthal. "That leaves Ms. Bryson to object if she choses; she hasn't filed anything."
Mr. Bernthal had contact Ms. Kathleen Bryson yesterday. She is the attorney for John Doe. Even at the last court hearing, Ms. Bryson wasn't sure if she was going to file an objection.
Ms. Andrea Sullivan is Rodriguez's attorney. She told Judge Killoran that John Doe is a monolingual Spanish speaker and it would take time to translate the text messages. At her request, a pre trial date was set to see if the case could resolve. Mr. Bernthal said he was open to discussions.
Pre trial to see if case can be resolved is on October 18; trial confirmation is on November 15 and jury trial on December 6. Time estimate is 5 weeks.
