Liberty Healthcare search for Cooley on hold, defense once again requests more time

 


Setting for oral arguments on the Judge John Feeney's motion for reconsideration of release for sexually violent predator Joshua Cooley and defense request to leave transitional order in place was scheduled for April 9.

Dates had been scheduled in March and April but at the last court hearing, Cooley's attorney, Conflict Counsel Supervising Attorney Meagan O'Connell filed a motion to leave the order for transitional release in place.  She requested more time to respond to the Court's motion. 

Once again, a repeat of the last hearing. Dates were scheduled, defense requested more time. Liberty Healthcare's search is on hold until these motions are heard. Dates were reset. Defense motion for live testimony was denied. 

Defense has submitted a funding order and plans to retain an expert. COVID 19 has impacted everyone and investigations. These constant delays benefit the defense. As I pointed out, if time runs out,they can argue for Cooley to be released and to Humboldt. That strategy has been very apparent.

Deputy District Attorney Stacey Eads appeared for the People. Ms. Eads expressed concern that since she has no idea what Ms. O'Connell will present; it may require People doing additional investigation. 

Representatives from Liberty HealthCare including Dr. Cameron Zeidler and Rafael Loya appeared via Zoom.

Judge Feeney said opening briefs are due May 28, reply briefs June 8 and hearings on motions June 11.
