Richard French placed on two years formal probation and will be released from custody today

 


Richard French was just sentenced. On March 16, French resolved both his cases with an open plea.Today, French was placed on two years of formal probation.

Judge Christopher Wilson had already indicated he would place French on probation. Judge Wilson said that repeatedly so today's sentence was not a surprise.

Judge Wilson cited French's age and mental health issues, as he has done previously, regarding his decision to place French on probation. 

French will be released from custody today. Judge Wilson explained to French that if he violates probation he could face a prison sentence.

French pleaded guilty in his misdemeanor case to violating a court order. In his other case, he pleaded guilty to one count. That is Count 3, PC 245 (a) (1), assault with a deadly weapon. French will accrue credits in the felony case.

Deputy District Attorney Roger Rees is the prosecutor for this case. Deputy Public Defender Ben McLaughlin is French's attorney.

The victims were notified and were agreeable to the plea with certain terms and conditions which include French agreeing to mental health treatment and French being prohibited to enter the victims' properties.

Victim Bryan Richter made one request which was sort of granted. He wanted the stay away increased from 100 yards to 1,000. Judge Wilson made it 500 yards.

 like the length of the stay away order being increased. Other conditions the victims requested were not legally viable such as a lifetime ban from Hydesville, a sundown clause and preventing French from ever filing a lawsuit again.

Restitution was reserved. French waived 152 custody credits to be placed on probation.

French's family has indicated they will take care of the property in Hydesville.
