Carson mansion, "jacked up white truck" and gunshots mentioned in Brian Daniels' jury trial


Around 2 p.m., attorneys were questioning jurors. It is now 3:40 p.m. and the People are already presenting witnesses in the Brian Daniels case.

Dale Cloutier is the senior criminalist at the Eureka lab for the California DOJ. He has testified at many local court hearings. His wife,Joanna Cloutier, was with her friend,Christina Rosenfeld in Old Town near the Carson mansion and heard someone yelling from a "jacked up white truck".

"Whatever it is just downtown Eureka" said Mrs. Cloutier. Then shots rang out. The shots were fired into what seemed to be an empty lot.

Ms. Cloutier and her friend, Ms. Rosenfeld were near a RAV. The friend had a CCW and was struggling to get a handgun out. They were scared.

Ms. Cloutier did not see Daniels, she saw an arm holding a gun, saw "muzzle flashes" and heard expletives. The incident occurred on December 26, 2018 at 7:30 p.m.

Ms. Cloutier spoke with EPD Officer Ryan Swanson and gave a statement. She only spoke with Officer Swanson over the phone and said he seemed rushed.

Later, Ms. Cloutier sent an email to EPD Chief Steve Watson. At that time, she did not know that Daniels was the shooter. She expressed some strong feelings about dummies and frontal lobe endangering the citizens of Eureka. Years later, frustrated with the constant delays in this case going to trial and by then being familiar with Daniels' criminal history, Ms. Cloutier wrote to District Attorney Maggie Fleming  about "throwing the book" at him and sending a message about the Wild Wild West Eureka atmosphere.

"If you just google Brian Daniels" Ms. Cloutier started to say and Judge Kelly Neel stopped her. 

While I understand why Judge Neel did that, no one else has written about Brian Daniels' court cases or written as extensively about him as I have. The only coverage by other local media is a press release about his being arrested for a DUI and hit and run.

Locals know who Daniel's dad is; despite those connections and information, the rest of the local media has ignored the case.  

Ms. Cloutier formerly worked with for the Marine Corp. Her feelings would be shared by many in  Humboldt County who are law abiding.

Jurors will not be back until Tuesday.

Deputy District Attorney Luke Bernthal is the prosecutor who is doing the trial because Deputy DA Roger Rees is in another trial. Deputy R.J. Leohner is Daniels' attorney.
