Mark Dare's Marsden granted, Reavis out, Clanton takes over


Judge Christopher Wilson was expected to announce his  ruling on convicted molestor Mark Dare's Marsden hearing this morning. The hearing took place last week. Typically, the ruling is done the day Marsden is heard.

Even if Judge Wilson needed to close the courtroom for the ruling, the part regarding the motion for a new trial should have been in open court. 

The Marsden was granted. Russ Clanton is Dare’s new attorney. The attorney who defends most of the convicted and child molestors in Humboldt now gets to delay Dare's sentencing, argue for anew trial and delay the victims' trauma and healing.  

Setting for the motion for a new trial is on 5/19. Mr. Clanton had been appointed for a limited purpose. Public Defender Marek Reavis was Dare's attorney.

Deputy District Attorney Whitney Timm is the prosecutor for this case. I did not even see her in the courtroom and her appearance was not even acknowledged on record by Judge Wilson.

 I reached out to her. The ruling was done without having Ms. Timm being called give any input on court dates. She was informed in the hallway by Mr. Clanton and Mr. Reavis.
