"Given the significant nature of issues in this case" Judge Reinholtsen orders further evaluation of Sohum upskirting suspect David Nunez


Sohum upskirting suspect David Nunez was scheduled to be sentenced on July 26.

Judge Dale Reinholtsen had received a sentencing statement from the Deputy District Attorney Whitney, a probation report and today in court, a letter from Nunez's counselor was submitted by Mr. Neal Sanders who is  Nunez's most recent attorney.

Nunez has had a few attorneys.

The probation report suggested additional evaluation of Nunez. One of the issues to be decided is whether Nunez should be ordered to register as a sex offender, according to PC 290.006.

Ms. Barnes suggested a PC 288.1 evaluation. PC 288.1 applies to a person convicted of committing any lewd or lascivious act.

Mr. Sanders said he did not know if a full PC 288.1 was necessary. Today, was the first time it was mentioned in court that Nunez had been seeing a counselor "for months."

"Given the significant nature of issues in this case," Judge Reinholtsen ordered a report to be prepared by Dr. Renouf. Status of that report is set for August 23rd at 9:15.
