Homicide suspect in jail marries his co-defendant who allegedly drove the getaway car

So many criminals; not enough time. Humboldt criminals multiply faster than a rabbit. Factor in the constant backlog, continuances and jammed up local courts with inefficient court admin and the last two Presiding Judges and staff shortage hemorrhaging faster than a wound at the ER, I had forgotten about this duo. Until this week when I was stuck in court for hours.

Devon Preston Cathey was arrested by Arcata Police Department on November 15 on a Ramey warrant for PC 182(a) (1), PC 187(a) murder.

Vonda Joyce Carlson was arrested by APD on November 15 on a Ramey warrant for PC 32 harbor,conceal.or aid a person committing a felony. Carlson is represented by Deputy Conflict Counsel R.J. Leohner.

I had contacted APD Chief Brian Ahearn and these arrests were a result of an investigation by APD into the death of Nicklas Sellars. A press release was issued after my post which is included in prior coverage.

Cathey and Carlson took up two days and time in Humboldt Superior Court because of the games they are playing with the system.  Yesterday, Carlson failed to appear for court. Cathey claimed all sorts of things about whether Carlson was there or not earlier. No one could confirm that she had been present. And today, Carlson herself exposed Cathey's lie by claiming she thought court was next week.

Mr. Leohner tried to appear for her 977 but Retired Judge Christopher Wilson told him there was no waiver of personal appearance in the file and minutes showed Carlson was ordered to appear. A bench warrant was issued and held until today. Bail amount was $50,000. Mr. Leohner's attempt to minimize his clients' actions by claiming that Cathey just jumped into Carlson's car did not work. It was reminiscent of Ms. Kathleen Bryson saying Melissa Johnson, mother of convicted murderer Mauricio Johnson, just followed "the caravan of evil to Utah."

Deputy District Attorney Whitney Timm and Ms. Sullivan had to repeat what they said in court again at today's hearing about the DA still investigating and Ms. Sullivan's schedule. Cathey kept speaking up in court and revealed Carlson is his wife. They got married while Cathey is still in jail. 

The jury trial was scheduled on a short set because Carlson refuses to enter a time waiver. Cathey keeps going back and forth like a bobblehead about time waivers and screwing up his attorneys' pre planned vacation and ability to properly prep for his trial. Ms. Sullivan is unavailable from July 26 to August 6. The 60th day is August 7.

Ms. Timm said, "We are still in the process of conducting forensic testing." Analysis of DNA on pants needs to be done by the DOJ. It will not be done before August. A firearm report needs to be done by DOJ and several witnesses are unavailable in July. Judge Wilson found good cause to continue.

Mr. Leohner objected. Ms. Sullivan was open to alternative setting. Trial confirmation is on 7/12; jury trial on 7/24.

Although Judge Wilson recalled the warrant and reinstated the bond with any fees imposed by Bill Davidson Bonds, he did not buy Carlson's excuse that she thought she had to be in court on June 19. Judge Wilson told her that it is a court holiday. "When the court orders you to appear and you fail to show up, your custodial status is at risk."

7/12: Deputy District Attorney Trent Timm appeared for Deputy DA Whitney Timm who is in trial. She has another sex abuse trial set for the same time and been in 5 trials back to back. DA requested further trial confirmation on 7/17. There was no objection by Ms. Sullivan because forensic testing of firearm has not done by the People and defense needs firearm results. Jury trial is scheduled for 7/24.

7/17: Jury trial scheduled for 7/24 confirmed.

7/24: On 7/21 Ms. Sullivan's motion to continue granted over co-defendant's objection. Good cause due to recent discovery. 7/24 date vacated. Trial assignment on 8/4; jury trial 8/7.

8/4: Motion to continue by Ms. Sullivan granted. 8/7 date vacated. Jury trial rescheduled for 8/28.
