Looks like the City of Eureka's lack of response will result in another petition and CEQA lawsuit, this time about the 5th and D parking lot. The City of Eureka received a notice of intent yesterday. This was confirmed by Eureka City Manager Miles Slattery and City of Eureka attorney Autumn Luna. Security National spokesperson  Gail Rymer said a petition regarding 5th and D will be filed next week. I will have an update after the petition is filed.

On April 4, I was the first to report and the only one to publish the comment letter submitted to Eureka City Council about the 5th and D Parking lot. The letter asserts that the City of Eureka "failed to disclose and mitigate the potential significant adverse environmental impacts associated with the project." 

On April 27, I did a post that it has been more than three weeks since the City of Eureka was notified of the lawsuit filed by Citizens for a Better Eureka. 

That litigation alleges that the City of Eureka failed to meet the CEQA requirements for the low income housing on downtown parking lots. The plaintiffs are asking the Court to stop the City of Eureka from taking further action and do another study on traffic and safety impacts.

Regarding that lawsuit, Security National spokesperson Gail Rymer had told me, "The petition focuses on the city’s adoption of its General Plan Housing Element Update, which identified a number of additional parking lots that the city intends to redevelop into residences. The lawsuit does not focus on any one particular lot."
