Jason Miller aka "Crow" preliminary hearing in his homicide case finally started today. Trial setting in his assault case is trailing.
In the homicide case, Miller is charged with one count of murder of Kiera Lynn Foley and special allegation that he "personally and intentionally discharged a firearm, a handgun, which caused great bodily injury and death" to Foley.
In the assault case, Miller is charged with one count of battery with serious bodily injury upon convicted sex offender Mark Dare.
Ms. Andrea Sullivan is Miller's court appointed attorney. Deputy District Attorney Roger Rees and Deputy DA Jessica Watson are the prosecutors. There are three live witnesses and one officer,EPD Det. Timothy Marsolan.
The preliminary hearing was supposed to start this morning. At 1:30 we found out where it is being held . Court staff is met before the hearing to see whether it would be held in Courtroom 2 or 4.
It commenced in 2 with Judge Kaleb Cockrum presiding. Miller waived his right to a continuous preliminary hearing. About 10 family members and friends were in court.
Self professed drug addict Crystal Anita Gonzales was first on the stand. The next witness on the stand was Rose Cooper, a name you will recognize. She has been arrested several times. Cooper dated Miller and knew Foley.
