Sexually violent predator and convicted spousal rapist Scott Eden's jury trial scheduled for May 17 is proceeding and it has been assigned to Del Norte Superior Court Judge Robert Cochran.
This is the second one; the last one ended in a mistrial. New evidence was discovered a year ago.
Assistant Deputy District Attorney Stacey Eads is the prosecutor for the case. Deputy Public Defender Wade Orbelian is Eden's attorney.
There was discussion about scheduling, motions in limine, jury selection and peremptory challenges and how voir dire will be conducted. So far, I like Judge Cochran's demeanor and the way he runs his courtroom.
Eden is still objecting to any expert witness testimony by Zoom. Three week time estimate. People have two experts and "potentially one police officer." Defense has two experts.
"Due to COVID 19 and restrictions in the jury assembly room, we are struggling to get large panels," said Humboldt Superior Court Operations Manager Kelly Nyberg. Then she described the process Humboldt Superior Court is using for jury selection.
Contrary to Ms. Nyberg's bragging about how proficient Humboldt Superior Court is to Judge Cochran, the many issues and chaos on the second floor of the Courthouse continue.
That includes Judge Robert Cochran waiting in Courtroom 1 because other coutrooms were running late and the attorneys are stuck in another courtroom. These delays impacting court calendars have a domino effect.
Three weeks in a row, retired and Visiting Judges have had to pick up the slack because one particular Judge is not around. The fact that things are operating smoothly have to do more with frontline court staff and attorneys picking up the slack than the top 3 people in charge in Humboldt Superior Court with big egos who refuse to take responsibility for the chaos they created.
