"Tim asked the other two boys to exit the trailer and then Tim raped her."

 

The incident involving alleged rapist Timothy David Miller-Roberts took place in Mckinleyville in May 2021. The alleged victim is a minor.

I am not going to put any information about the address. The alleged victim is a minor and she will be referred to as Jane Doe. There are juvenile males who are her friends. Their names and their parents' full names were mentioned on record but I will be using initials of the first name. Miller-Roberts girlfriend Kasey Deslieres walked in and found Jane Doe in bed with him. 

HCSO Corporal Peter Leipzig testified that he spoke with Jane Doe and her mother. Jane Doe is almost 5 feet; Miller-Roberts 6 feet and "a little over 200 pounds."

Doe said she had "abdomen pain" and"vaginal pain." She was "fuzzy" and "disoriented."  Her friend "D" and his parents live in the main residence. Another friend "T" was present that night. Miller-Roberts and his girlfriend live in a trailer on the property.

That night was the first time Jane Doe had smoked marijuana and had alcohol. She drank a "Solo cup of vodka mixed with peach tea."

"Tim asked the other two boys to exit the trailer and then Tim raped her," said Deputy Leipzig.

"She described Tim being on bed with her. Tim removed her pants and underwear. She was on her back. Tim inserted his penis in her vagina."

"The rape occurred over the period of an hour to two hours." Due to the effects of the alcohol and marijuana, Jane Doe was unclear on some details.

"She told him no. He didn't say much during the act but held her down on the bed. She felt pain vaginally and on her arms."

Jane Doe "doesn't believe Tim wore a condom and Tim ejaculated inside her. He made a comment about ejaculating in her."

"During the course of the assault, Tim moved her in a position where her knees were on the bed and face down and continued to rape her. She felt helpless."

"Tim's girlfriend came home." Tim put Jane Doe's clothes were back on her. Jane Doe was unclear how the assault ended but it was over when the girlfriend arrived. After the rape, she just lay on the corner of the bed. Tim's girlfriend got in bed with both of them and lay in between Tim and Jane Doe."

Jane Doe had made several calls to her mother. She finally got up and left the property.

A SART exam was conducted by Nurse Jennifer Hovie. She has been a SART nurse for 5 years and the SART coordinator at St. Joseph's for 3 years.

During the SART exam, there was "observation of Jane Doe's genitals. She located vaginal redness and in her experience, this was consistent with sexual assault."

Jane Doe had bruising in both arms; "in the elbow range."

Leipzig said other deputies had detained Miller-Roberts in a patrol vehicle. The trailer was searched. Miller-Roberts had been identified by Jane Doe via a Facebook profile. Miller-Roberts was arrested.

A blanket was collected from the scene. Sent to DOJ with other DNA evidence including toxicology and urine samples from Jane Doe. Nothing has been returned. There was no CAST interview.

Jane Doe's parents did not want her staying overnight at the Mckinleyville residence. The two boys "D" and "T" stayed in another trailer on the property.

HCSO Deputy Cole Kane identified photos taken of Miller-Roberts trailer of the exterior and interior. There were Solo cups and peach tea on the floor, a bong, "marijuana bud in clear plastic bags and some loose bud on a laptop" and clothes in the sitting area as well as cups and other items on the counter. "There was no place to sit."

Deslieres owned the trailer. She gave consent for the search. Kasey said zhe did not know anything but when she came home in the morning she saw "Timothy in bed with a juvenile." She did not know Jane Doe. Deslieres said there was evidence that "Timothy and she had sex."

"T" smoked weed that night but no alcohol. 

After he was transported to the jail, Miller-Roberts consented to a SART kit. He gave consent to look through his cellphone.

Deputy District Whitney Timm is the prosecutor for this case. Deputy Public Defender Casey Russo is his attorney.
