No deal in case where alleged victim has arrests and defendant claims he was drugged by meth fumes being blown in his face

 


Change of plea for attempted murder suspect Matthew Ramsey did not go through this morning.

 Judge Lawrence Killoran did not have a plea form. Whatever Mr. Russ Clanton discussed with his client was not the offer by Deputy District Attorney Luke Bernthal. 

The offer by the People was to plead guilty to assault with a semi automatic weapon and to the special enhancement of a personal use of a firearm.

There was back and forth between Mr. Bernthal and Mr. Clanton about the maximum potential of 19 years and the plea form stating 12 years. Mr. Clanton did not want his client to agree to the special enhancement or the People's offer.

I couldn't hear Mr. Clanton because he was away from the mic. I don't really care. This is another Humboldt case that made the headlines and is full of drama and colorful and crazy characters.  The alleged victim has been arrested more than once. Testimony during the preliminary included claims by Ramsey that his neighbors had drugged him with meth for years by blowing fumes in his face. No test was conducted to confirm this claim. 

It should resolve. Instead, Mr. Clanton pulled the time waiver on the felony case for his client and the misdemeanor will "trail." 

Trial confirmation is on June 22 and jury trial is on July 6.
