Oregon warrant, similar charges and text messages about possible marijuana sales raised at bail hearing

 


Alleged rapist Timothy Miller-Roberts' OR/bail hearing was continued to this morning and "put over" to tomorrow for additional information from Oregon. Bail is $75,000.

After the preliminary hearing, Miller-Roberts was held to answer to PC261(a)(3) rape of an intoxicated victim and PC288(c)(1) lewd and lascivious acts with a child under 14. 

Deputy District Attorney Whitney Timm is the prosecitor for this case. Deputy Public Defender Casey Russo is Miller-Roberts' attorney.

Mr. Russo mentioned pre-trial detention, Humphrey, ankle monitor for release or asked bail be reduced to $5,000 to $10,000.

Ms. Timm said Miller-Roberts is a flight risk. "He is likely to flee.

"Defendant has another open case in Oregon with charges similar to statutory rape,"  said Ms. Timm. He was ordered to stay away from minors." Ms. Timm said there was a warrant out for Miller-Roberts arrest in Oregon.

Jane Doe's mother is opposed to his release. Jane Doe is terrified.

Law enforcement located messages between"D" and Miller-Roberts about buyers of marijuana. Ms. Timm said he is not being honest. "People ask bail remain set."

Judge Kaleb Cockrum said he was concerned about the warrant. Even though Ms. Timm has a police report and a DA Investigator spoke with a DA's office in Oregon, Judge Cockrum wants paperwork. He wants to see the terms of any release and expressed concern that Miller was told to stay away from minors.

5/25: Bail remained as set per the bail schedule due to Miller-Roberts failure to comply with court orders and failure to appear in other court cases. He was not denied bail.

The documents from Oregon showed failure to appear and a warrant issued on his case there.  He

is facing three charges from Oregon: sex abuse III, sex abuse III, sexual misconduct.

The condition Ms. Timm stated yesterday was no contact with the minor who is the alleged victim in Oregon.

Another condition for Miller-Roberts release was that he was not allowed to use intoxicating substances.  Ms. Timm told Judge Cockrum that Miller-Roberts had marijuana and alcohol and told the officers that he had consumed those. This was stated during the preliminary hearing in Humboldt.
