Alleged Mckinleyville statutory rapist goes into medical distress during his preliminary hearing

 


Timothy David Miller-Roberts was arrested on May 2 by HCSO and booked for PC261.5(d) statutory rape, PC261(a)(3) rape of an intoxicated victim and PC288(c)(1) lewd and lascivious acts with a child under 14. In the complaint by the DA, he is only charged with two counts, PC 261 (a) (3) and PC 288 (c) (1).

Deputy District Whitney Timm is the prosecutor for this case. Deputy Public Defender Casey Russo is his attorney.

Today, he had his preliminary hearing. In the middle of his hearing, he was in "medical distress." The hearing was not going well for Miller-Roberts.

When livestream resumed, Mr. Russo told Judge Kaleb Cockrum that Miller-Roberts could not sit in court. "He is okay to proceed without his presence but out of abundance of caution, I am requesting a continuance." Mr. Russo said that Miller-Roberts "current state of mind" was not conducive to making important decisions. Mr. Russo apologized to the People's witnesses.

HCSO Corporal Peter Leipzig is the lead investigator, he testified first. Then it was HCSO Deputy Cole Kane. HCSO  Sgt. Andrea Sherrod is next to testify. 

The preliminary is expected to resume tomorrow.
