Two brutal rapes, including his wife despite two prison sentences, it is obvious he is a sexually violent predator

 

Convicted spousal rapist Scott Eden trial on the petition to declare him a sexually violent predator is being heard by a jury.

Assistant Deputy District Attorney Stacey Eads opening statement said Eden was convicted  of intent to rape and kidnapping. He served time in prison. 

"Despite going to prison, Mr. Eden reoffended. Eden was convicted of spousal rape. "He raped his wife regularly over a five year basis," said Ms. Eads. "By his own statement, he raped his wife once a week."

"The last time he raped his wife, she was recovering from surgery. Despite her protests, he raped her. He inserted his penis into her vagina. He inserted a flashlight into her vagina."

Eden was convicted of two counts; spousal rape and forcible penetration with a foreign object.

Prior to being released from prison, he was evaluated per the sexually violent predator law.

Just like sexual violent predator Joshua Cooley, the amount of time and resources wasted on this unremorseful monster who reoffends is a travesty.

Deputy Public Defender Wade Orbelian wasted a lot of time in motions on limine. This is the second trial. The first one resulted in a mistrial.

There was a letter written by one of Eden's victim in 1989/1991 that was not discovered until January 2020 and only due to the diligence of an individual who had experience with microsheets. Prior to that, the People had made multiple requests. It had been referenced in police reports so defense was aware. 

The letter made a difference to one of the evaluators the defense was planning to call. That doctor changed her opinion about Eden being a sexually violent predator after reading the actual letter from the victim. Again, a waste of time  and delay on an unneccessary motion by Mr. Orbelian. Judge Cochran denied his motion. 

There were previous allegations of child molestation but Eden was not convicted. The allegations did lead to the investigation of the rape charges.

The jury will not hear about those charges but Ms. Eads  because it is not pertinent to this trial, yet Mr. Orbelian used up time  when courtrooms are premium and jury trials are backlogged.

Eden was not in bed with a child but he was in a separate bed masturbating.

Del Norte Superior Court Judge Robert Cochran denied the motion for dismissal. It had already been determined"not appropriate" by another Judge previously. "A writ could have been done," said Judge Cochran.

"COVID has been a nightmare for the entire state," said Judge Cochran. "That is neither parties fault."

There are four expert witnesses and "potentially one police officer". I do not need to hear four doctors psycho babble to know Eden is a sexually violent predator. You can watch the livestream. I am interested in the jury's verdict.
