"If you assign the Public Pretender, you are comitting a crime your honor"

 

James Pawlyk was arrested on May 6 for a parole violation. On May 17, he pulled his old tricks and refused to come to court. Arraignment was continued to this afternoon. 

"I exercise my right to remain silent," Pawlyk yelled at Judge Lawrence Killoran. "At the same time I can interject!"

"If you assign the Public Pretender, you are comitting a crime your honor," said Pawlyk.

Judge Killoran did appoint the Public Defender. Deputy Public Defender Adrian Kamada was in the middle of accepting appointment, Pawlyk yelled, "Who are you?"

Mr. Kamada stated his title and told Pawlyk, "I suggest you exercise your right to remain silent."

"You keep your mouth shut," Pawlyk yelled at Mr. Kamada. "These are legal documents." Then he yelled a threat to Mr. Kamada. Pawlyk was holding a stack of papers.

Things got worse when Mr. Kamada mentioned a "suspicion of 1368." Pawlyk went off.

Judge Killoran ordered Pawlyk to be put on mute due to his behavior. After arraignment was completed and dates were scheduled, Pawlyk's mic was unmuted. 

"I committed no crimes," stated Pawlyk. "Counsel tried to murder me with his deputies on Samoa beach."

Judge Killoran thanked Pawlyk for coming to court.

"It was against my will," responded Pawlyk.

Time was not waived. Confirmation of counsel was scheduled for tomorrow; a probable cause hearing on May 20 and parole revocation hearing on June 8.

I already knew what would happen at James Pawlyk's arraignment. It was deja vu. In fact, I knew he would be back in the system. I have covered Pawlyk before his most recent  arrest. Pawlyk was sentenced to a prison after a stint at Napa State. Before he went to Napa, Pawlyk  claimed to be a Shasta County Judge and a FBI agent in court. He has used the Public Pretender line before.

If Pawlyk is declared incompetent, again and sent to Napa, he will be sent back to Humboldt eventually. And, repeat. 

Unfortunately, that is the criminal justice system in California and the consequence of criminal justice reform that does nothing for mental illness nor does it protect the public from criminals. The financial and personal cost is to the taxpayers while the politicians and government get rich on your dime.

5/19: PD confirmed and remain counsel. Doubt was not declared. 

Deputy District Attorney Emily Norgaard appeared on the case for arraignment. Deputy DA Steven Steward for today's hearing.
